Land Taken and Road Stopped in Blocks VIII and XI,
Wharepapa Survey District, Otorohanga District

Pursuant to Part VIII of the Public Works Act 1981, the Minister
of Works and Development:

(a) Pursuant to section 119 (1), declares the land described in the
First Schedule hereto to be taken.

(b) Pursuant to section 116, declares the road described in the
Second Schedule hereto to be stopped.

(c) Pursuant to sections 117 and 119 (1), declares the land taken
described in the First Schedule hereto and the stopped road
firstly described in the Second Schedule hereto now known
together as Section 69, Block VIII, Wharepapa Survey
District, and the stopped road secondly described in the
Second Schedule hereto now known as Section 70, Block
VIII, Wharepapa Survey District to be vested in Donald
Samuel Bryant of Te Awamutu, farmer, subject to
memorandum of mortgage No. H. 6710066.2, H. 570701.2,
H. 178594.2, South Auckland Land Registry.

FIRST SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

ALL that piece of land containing 3 acres 1 rood 13.1 perches, being
part Section 15, Block XI, Wharepapa Survey District; coloured
yellow edged yellow on S.O. Plan 46768, lodged in the office of the
Chief Surveyor at Hamilton.

of Works and Development declares the land described in the
Schedule hereto to be road and vested in The Otorohanga District
Council.

Amending a Notice Declaring Land to be Road and Road
Stopped and Vested in Block IV, Linkwater Survey District,
Marlborough County

Pursuant to section 55 of the Public Works Act 1981, the Minister
of Works and Development hereby amends the notice dated the
12th day of February 1987 and published in the New Zealand Gazette
of 19 February 1987, No. 23 at page 799, declaring land to be road
and road stopped and vested by omitting the following from the
preamble:

“(b) Pursuant to sections 116, 117 and 120 (3), declares the road
described in the Second Schedule hereto to be stopped and
amalgamated with the land in certificate of title No. 3E/93,
subject to memoranda of mortgage No. 110530.3 and
132952, caveat No. 133442 and electricity agreement
No. 57411, Marlborough Land Registry.”

and substituting the following:

“(b) Pursuant to sections 116, 117 and 120 (3), declares the road
described in the Second Schedule hereto to be stopped and
amalgamated with the land in certificate of title No. 3E/93,
subject to memoranda of mortgage No. 110530.3 and
132952 and caveat No. 133442, Marlborough Land
Registry.”

Land and Easement Over Land, Acquired for a Waste-Water
Treatment Plant in Block X, Tauhara Survey District, Taupo
County

Pursuant to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares that, an agreement to that effect
having been entered into, the land described in the First Schedule
hereto is hereby acquired for a waste-water treatment plant, the
right of way easement described in the Second Schedule hereto is
hereby acquired for a waste-water treatment plant over the land
described in the Third Schedule hereto, and further declares that
the said land and easement shall vest in the Taupo County Council
on the 21st day of May 1987.

Land Acquired

ALL that piece of land containing 2400 square metres, situated in
Block X, Tauhara Survey District, being part Tauhara Middle 4A119
Block; as shown marked “A” on S.O. Plan 55981, lodged in the
office of the Chief Surveyor at Hamilton.

SECOND SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

Description of Easement to be Acquired

In respect of the land described in the Third Schedule hereto a right
of way with the rights and powers which are implied in and attaching
to a right of way as set out in the Seventh Schedule to the Land
Transfer Act 1952 under the heading “Right of Way” applying
thereto as if the same were fully set out herein and other rights and
powers as set out in paragraphs 2, 4 and 5 of the Seventh Schedule
to the Land Transfer Act 1952 relating to rights to convey water
and to rights to drain sewage and additional rights attaching to
easements of right to convey water and to drain sewage.
