Notice is hereby given that a petition for the winding up of the above-named company by the High Court was, on the 25th day of September 1986, presented to the said Court by Produce Markets LIMITED, a duly incorporated company having its registered office at Auckland; and that the said petition is directed to be heard before the Court sitting at Rotorua on the 9th day of March 1987 at 10 o’clock in the forenoon; and any creditor or contributory of the said company desirous to support or oppose the making of an order on the said petition may appear at the time of hearing in person or by his counsel for that purpose; and a copy of the petition will be furnished by the undersigned to any creditor or contributory of the said company requiring a copy on payment of the regulated charge for the same.

IN THE MATTER OF Part III of the Charitable Trusts Act 1957, and IN THE MATTER OF terms of a trust recorded in an order issued out of the Supreme Court under No. 259 of the 16th day of February 1897, declaring the below mentioned applicant as trustees, and IN THE MATTER OF an application by the Deacons’ Court of Knox Church Dunedin Incorporated for approval of a scheme for variation of trust—Applicant.

Notice is hereby given that the above-named applicant has made application to the High Court of New Zealand for approval of a scheme for variation of trust upon the ground that it is now impossible or impracticable or inexpedient to carry out the purposes of the original trust.

The scheme provides, inter alia: The applicant hold the land comprised and described in certificates of title 4B/584 and 4B/585 (Otago Registry), upon trust for the purposes of providing a church and ancillary buildings and subject to the following trusts, namely—

(a) that the applicant hold the said lands and any buildings thereon, together with any income from the said land or buildings, for the use of the congregation of Knox Church, Dunedin;

(b) that the applicant have the sole management of the said land, buildings and income and will maintain the same in proper repair;

(c) that the applicant have a power to mortgage the said land and buildings.

Full details of the proposed scheme are available for inspection at the High Court Office, Lower Stuart Street, Dunedin.

The Attorney-General has filed a report stating that the scheme is a proper one for approval, and the matter has been set down for hearing in the Dunedin High Court on Friday, 20 March 1987 at 10 a.m.

Any person desiring to oppose the scheme should give written notice of his intention 7 clear days before the date of hearing to the following persons:

  1. The Registrar, High Court, Lower Stuart Street (Private Bag), Dunedin; and

  2. The Applicant, care of Messrs Mirams Wilson & Newport, Barristers and Solicitors, Moray Chambers, 30 Moray Place West (P.O. Box 129), Dunedin.
