Declaring an Easement Acquired to Drain Stormwater Over Land for Prison Purposes in Blocks II and III, Te Mata Survey District, Hawke’s Bay County

Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, an easement in gross (to drain stormwater) is hereby acquired for prison purposes, (and may be surrendered at any time by notice in the Gazette) and shall vest in the Crown on the 10th day of December 1987, a right to drain stormwater by means of underground pipes through the land described in the First Schedule hereto, such grant being in accordance with the rights and powers contained in clause 5 of the Seventh Schedule of the Land Transfer Act 1952, provided that:

1. The Crown shall upon the exercise of any of the rights so granted restore the land as near as reasonably possible to its previous condition and make good any damage caused to services, buildings or other structures.

2. The owners of the land described in the Second Schedule will not interfere with the free passage of water through the pipes, or prevent or interfere with the full use and enjoyment by the Crown of the rights granted, nor plant trees or shrubs on the area marked ‘A’ nor work the soil in that area to a depth greater than 0.5 metres without first obtaining the Crown’s consent.
