Third Schedule

Terms and Conditions to which the Easement is Subject

1. That the grantor shall construct a concrete path and shall also supply and hang gates at each end of the right of way secondly described in the Second Schedule hereto.

2. That the grantor acknowledges that the grantee proposes to construct a pathway over the right of way firstly described in the Second Schedule hereto.

3. That the grantee shall assume all responsibility for future maintenance costs of the said right of way firstly and secondly described in the Second Schedule hereto.

Fourth Schedule

Right of Way—Dominant Tenement

All those pieces of land situated in Block IV, Maungaru Survey District described as follows:

Lot 1, D.P. 33906 (Gazette 1973, p. 1456) and part Lot 4, D.P. 9549 (Gazette 1955, p. 1328); as shown on D.P. 113377.

Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the leasehold estate in the land described in the Schedule hereto, held from the Crown by Glenbrook Run Company Ltd., a duly incorporated company having its registered office at Timaru by virtue of Pastoral Lease P. 238 O.U. and recorded in Register Book Volume 386, folio 127, Otago Land Registry, is hereby acquired for the generation of electricity and shall vest in the Crown on the 5th day of November 1987.

Pursuant to section 55 of the Public Works Act 1981, the Minister of Works and Development hereby revokes the declaration dated the 7th day of August 1987, published in the New Zealand Gazette of 20 August 1987, No. 139, at page 3981, acquiring land for road in the city of Auckland pursuant to sections 20 and 50 of the Public Works Act 1981.
