Land and an Easement Over Land Acquired for a Blockvalve Site in The County of Taranaki

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired, subject to Proclamation 306074 defining the middle line of the Motonui-Omata petrol product pipeline, for a Blockvalve site and vested in the Crown on the 29th day of October 1987, and further declares that the easement described in the Second Schedule hereto is hereby acquired for the said block valve site on the 29th day of October 1987 and shall be forever appurtenant to the land described in the First Schedule.

Description of Right of Way

THE full, free, uninterrupted and unrestricted right, liberty and privilege for the Crown (called "The Grantee") its servants, tenants, agents, workmen, licensees and invitees (in common with the registered proprietor of the said land (called "The Grantor") her tenants and any other person lawfully entitled so to do) from time to time and at all times by day and by night to go, pass and repass by motor car and four wheel drive vehicles over the land described in the Third Schedule hereto (called "The Servient Tenement") upon and subject to the following conditions:

1. The grantor shall be entitled to erect such farm gates on the servient tenement as are necessary for the carrying on of its farming operations.

2. The grantee may use other types of vehicles only after approval of the grantor has been obtained.
