the Tribunal that in his view these magazines provided attractive
crotic alternatives to unsafe sex and he held the view that magazines
of this type should be encouraged rather than restricted.
The full-bench of the High Court in a judgment delivered on
2 July 1987 Lawrence Publishing Co. (NZ) Ltd. v. The Comptroller
of Customs (M No. 341A/85) allowed an appeal against a decision
of the Tribunal in respect of the publication Gay Scene, Decision
No. 3/85. The Tribunal had classified that publication
unconditionally indecent largely because “it is directed towards
criminal activity”. Such classifications were frequently made because
the publications under consideration encouraged or seemed to
encourage male homosexual acts which were, until recently, criminal
offences in New Zealand.
The Tribunal, having given careful consideration to all of the
submissions and evidence, is satisfied that this publication should
be subject to an age restriction and accordingly finds it to be indecent
in the hands of persons under the age of 18 years and so classifies
it. The Tribunal wishes to make known to the publishers and
distributors of Advocate Men that it was concerned with the bondage
aspects of a great deal of the photographic displays in the August
issue and that that issue for that reason was very close to having
an unconditionally indecent classification passed upon it.

Private Schools Conditional Integration Act 1975
Pursuant to section 10 of the Private Schools Conditional
Integration Act 1975, notice is given that a supplementary integration
agreement has been signed between the Minister of Education and
the Proprietor of the following school:
St Bedes College, Christchurch.
The said supplementary integration agreement came into effect
on 7 August 1987. Copies of the supplementary integration
agreement are available for inspection without charge by any
member of the public at the Department of Education, Head Office,
National Mutual Building, Featherston Street, Wellington, and at
regional offices.

Notice of Intention to Apply for Ministerial Approval of Code of
Practice Under the Machinery Act 1950
Pursuant to section 268 of the Machinery Act 1950, I, Leslie James
Cope, the Chief Inspector of Factories of the Department of Labour,
hereby give notice of my intention, after 1 month from the
publication of this notice, to apply to the Minister of Labour for
his approval of the Code of Practice titled “Guidelines for Training
Operations of Powered Industrial Lift Trucks”.

Approval of Reflectors and Lights for Pedal Cycles
Pursuant to regulations 43 and 44 of the Traffic Regulations 1976
and pursuant to powers delegated to me by the Secretary for
Transport by an instrument of delegation dated the 3rd day of August
1987, I, Robert Norman Abram, Chief Automotive Engineer, hereby
approve reflectors and lighting equipment of the type described in
the Schedule hereto.
SCHEDULE
REFLECTORS and lighting equipment complying with NZS 5441 and
bearing the certification mark of the Standards Association of New
Zealand.

Notice of Exemption of Certain Motor Vehicles From the
Requirement to be Fitted with Interior Door Handles
NOTICE
Pursuant to regulation 90 (1) of the Traffic Regulations 1976* and
pursuant to the powers delegated to me by the Secretary for
Transport, I, Hugh Cameron Matheson, Senior Automotive
Engineer, hereby exempt from the requirements of regulation 82 of
the said regulations the motor vehicles described in the Schedule
hereto.
SCHEDULE
ANY motor vehicle designed exclusively for the carriage of
prisoners and which is operated by the Police or Justice Depart-
ments, or Her Majesty’s Forces, provided that means of exit from
the prison compartment is included and which is capable of being
released by a Departmental or Forces officer from the inside or
outside of the vehicle in an emergency.

Initiation of Dumping Investigation
Pursuant to the provisions contained in section 186H of the
Customs Act 1966, notice is hereby given by the Comptroller of
Customs of the initiation of the investigation to determine both the
existence and effect of the alleged dumping of the goods set out in
the Schedule, being satisfied that sufficient evidence has been
provided that:
- The goods exported or intended to be exported to New Zealand
are being dumped; and - By reason thereof material injury to an industry has been or
is being caused or threatened.
