Before the Indecent Publications Tribunal

In the matter of an application by the Comptroller of Customs for a decision in respect of the following publications:
Sex Love in Action, published by Verlag Silwa;
Private, No. 60 and No. 61 published by Private International;
Flair, No. 17 and No. 19 published by CPL Verlagsgesellschaft mbH;
Teenage Sex, No. 18 and No. 2, published by Color-Climax Corporation.

DECISION

These magazines were privately imported by parcels post through the port of Wellington in 1986. The Comptroller of Customs seized the publications and the importer was disputed such seizure and forfeiture. The publications were referred to the Tribunal for classification prior to the commencement of condemnation proceedings pursuant to the Customs Act 1966. Sex Love in Action contains pictorial portrayals of sexual intercourse, sodomy, oral sex and a variety of other sexual acts. What little written material is contained in this publication is coarse and gross in its description of sexual adventures and has absolutely no literary merit. Private No. 60 and No. 61, contains a collection of articles and readers' letters covering a wide range of subjects almost entirely of a sexual nature. It has many photographs portraying close ups of female genitalia displayed in a very crude way and accompanied by a text which the Tribunal finds coarse and offensive in the extreme. The book has no literary or artistic merit. Flair No. 17 and No. 19 have extensive photographic sequences of sexual activity of various kinds and both books are predominantly concerned with the prurient and lewd aspects of sex. Neither book has any literary or artistic merit. Teenage Sex No. 18 and No. 2 contains many sequences of the portrayal of sexual activity in many cases of the multiple type and are very much hard core pornographic literature. We classify all of these magazines which lack any redeeming features as unconditionally indecent.

Before the Indecent Publications Tribunal

In the matter of an application by the Comptroller of Customs for a decision in respect of the following publications: Drag Queens, Vol. 4, No. 3, published by Holly Publications; Male Male, Vol. 2, published by House One.

Heard at Wellington on 3 December 1986.

Appearances: P. J. Eggleton for Comptroller of Customs. No appearance on behalf of the importer.

DECISION

These publications were privately imported by parcel post at the port of Christchurch. The Comptroller of Customs advised the importer that he considered the publications should be forfeited to the Crown as indecent. The importer has disputed seizure and forfeiture of the publications on the grounds that they are for his own personal use.

In his submission to the Tribunal Mr Eggleton suggested that the publication should be subject to either age restriction or a classification of indecent.

Drag Queens, Vol. 4, No. 3 is a magazine which consists entirely of photographs of transvestite males and Male Male, Vol. 2 is largely a series of photographs of posed naked males with a small amount of text, most of which is a description of the person shown in the photographs and is largely unobjectionable. The Tribunal is satisfied that both magazines justify an age restriction and accordingly find them to be indecent in the hands of persons under the age of 18 years. In respect of the publication Drag Queens, Vol. 4, No. 3, the Tribunal adds the further restriction on its sale or distribution that it not be publicly displayed.
