DECISION

THIS publication was part of a commercial shipment imported by sea freight through the port of Auckland in April 1986. Copies of the publication were seized by the Collector of Customs at Auckland and the importer subsequently disputed forfeiture. The publication was referred to the Tribunal for determination and classification prior to the commencement of condemnation proceedings pursuant to the Customs Act 1966. The publication contains 130 pages of material and the great bulk of this represents a series of articles (some of which are quite well written) and deal with a variety of matters of a sexual nature. The publication does contain some of the objectionable features such as multiplicity of models which have on many occasions resulted in a classification of indecent. The Comptroller of Customs in his submission through Mr Eggleton points out that the publication is not dissimilar to the publications Forum Adviser Spring 1980 and Forum Lifestyles Summer 1980 both of which were considered by the Tribunal to be indecent in the hands of persons under the age of 18 in its decision No. 1013 as was the publication Sexology, Volume 45, No. 8, 9 and 10 recorded in the Tribunal's decision 946 of May 1980.

The Tribunal finds that there are a number of elements of the publication which would be harmful to younger readers and thus injurious to the public good and accordingly it classifies the publication as indecent in the hands of persons under the age of 18 years.

Customs Exchange Rates Notice (No. 2) 1987

PURSUANT to section 143 of the Customs Act 1966, the Comptroller of Customs, in accordance with the power delegated to him by the Minister of Customs under section 9 of that Act, hereby gives the following notice.

NOTICE

  1. Short title and commencement—(1) This notice may be cited as the Customs Exchange Rates Notice (No. 2) 1987.

(2) This notice shall come into force on the 19th day of January 1987.

  1. Exchange rates—Where under any provisions of the Customs Act 1966 any amount which is required to be taken into account for the purpose of assessing duty or any other purpose is not an amount in New Zealand currency, the amount to be so taken into account shall be the equivalent in New Zealand currency of that amount ascertained in accordance with the rate of exchange set out in the Schedule to this notice.

  2. Revocation—The Customs Exchange Rates Notice (No. 1) 1987, published in the New Zealand Gazette, No. 205, dated 18th December 1986, on page 5514 is hereby revoked.
