Restricting the Use of Land in the City of Waitemata

Pursuant to section 187 of the Public Works Act 1981, the Minister of Works and Development hereby restricts the use of the land described in the Schedule hereto to pastoralism and horticulture which utilise the soil as the growing medium. This restriction prohibits any building, structure, improvement or use where people are likely to live, habitate or assemble including any dwellinghouse, accessory building, garage, haybarn, stockpens/yards, fertiliser bins, implement sheds, camping grounds, picnic grounds, playing fields, field days etc. or any other use which is inconsistent with the intentions of the current Local Authority zoning (as at the date of publication of this notice) but does not include farm workers going about their ordinary work or structures for pastoralism or horticulture such as fences or tee-frames. Any other uses will not be permitted except with the consent of the Minister of Works and Development.

The restriction is for the safe functioning of Defence Works (Hobsonville explosive store).

The aspect of the safe functioning of this work for which the restriction is considered necessary is public safety i.e. to limit the number of persons who might be endangered by any explosion on the explosives store site.

As shown edged green on Defence Plan 1335/09/001, lodged in the office of the District Commissioner of Works at Auckland.

Protection of Sambar Deer Anywhere Within the North Island of New Zealand Except During Specified Hunting Seasons
PURSUANT to section 8 (4) (a) of the Wild Animal Control Act 1977, the Minister of Forests hereby revokes the notice dated the 14th day of April 1983, and hereby declares, pursuant to section 8 (4), that the hunting, killing or having in possession of sambar deer (Cervus unicolor) anywhere within the North Island of New Zealand by persons other than Forest Service employees or agents is prohibited from and including the 31st day of December 1986, except where the following circumstances apply:

The deer is held for farming or other lawful purpose under a valid Forest Service permit to hold; or
-
A hunting season has been declared by the Minister of Forests for either the Bay of Plenty or Manawatu sambar deer herds and the person hunting, killing or having in possession a sambar deer holds a valid Forest Service permit or licence to so do; or
-
Where no hunting season has been declared but sambar deer are causing damage to vegetation, soils, waters, or wildlife and a Forest Officer has properly assessed such damage, he may apply to his regional controlling officer for and issue a permit to take a specified number of sambar to any affected landowner or occupier:
Provided that no sambar deer shall be hunted, taken or killed at any other time or by any other means which is contrary to that laid down in any permit or licence or notice advising the periods and conditions under which specified age classes and sexes of sambar deer may be hunted.
This notice cancels the notice of 14 April 1983 and is for the purpose of protecting sambar on all lands except during specified hunting seasons or under permit or licence issued by the Forest Service.

- The name of Bay of Plenty Community College constituted by notice published in the New Zealand Gazette on 29 May 1986 is hereby varied to Bay of Plenty Polytechnic.
