At Wellington this 17th day of November 1986

Present:
His Excellency the Governor-General in Council

Whereas, pursuant to section 43 (4) of the Auckland Regional Authority Act 1963, the Auckland Regional Authority is entitled to exercise all the powers, authorities, and discretions vested in the Auckland Metropolitan Drainage Board by the Auckland Metropolitan Drainage Act 1960:

And whereas the said Auckland Regional Authority has petitioned His Excellency the Governor-General that certain portions of Waitemata City be included within the Auckland Metropolitan Drainage District, as described in the Schedules attached hereto:

Now therefore, pursuant to section 8 of the Auckland Metropolitan Drainage Act 1960, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:

ORDER

  1. Title and commencement—(1) This order may be cited as the Auckland Metropolitan Drainage District Order (No. 1) 1986.

(2) This order shall come into force on 1 April 1987.

  1. Boundary Altered—The boundaries of the Auckland Metropolitan Drainage District are hereby altered so as to include the portions of Waitemata City described in the First and Second Schedules.

  2. Determination of financial obligations—The financial obligations and assessment under the Auckland Metropolitan Drainage District Act 1960 of the Waitemata City Council with respect to the land described in the Schedule to this order shall be determined on and from 1 April 1987.


FIRST SCHEDULE

NORTH AUCKLAND LAND DISTRICTWAITEMATA CITY

1647 square metres, more or less, being Lot 1, D.P. 59307, situated in Block VI, Titirangi Survey District. Part certificate of title 10B/613.


SECOND SCHEDULE

All that area in the North Auckland Land District, City of Waitemata, bounded by a line commencing at the southernmost corner of Lot 6, D.P. 56335; thence proceeding south-easterly along the south-western boundary of Part Allotment 83, Waikowhai Parish to its intersection with Scenic Drive; thence southerly generally along the eastern boundary of Part Allotment 27, Waikowhai Parish, to its intersection with Woodlands Park Road; thence westerly along the northern side of Woodlands Park Road to the northeastern corner of an area of 0.07 perches shown on S.O. Plan 23931; thence northerly along a right line bearing 6° 52' to a point on the southern boundary of Lot 8, D.P. 56335; thence easterly generally along the southern boundary of Lot 8 aforesaid, and Part Lot 3, D.P. 19259 (contained in certificate of title 10B/613) to the south-easternmost corner of the last-mentioned Lot; thence northerly generally along the eastern boundary of that Part Lot 3, D.P. 19259 and Lot 8, D.P. 56335 to the point of commencement.

Pursuant to section 55 of the Public Works Act 1981, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 26th day of August 1968, and published in the New Zealand Gazette, 5th September 1968, No. 63, page 1631.
