Declaring a Water Supply Easement to be Acquired in Block XIV,
Whitianga Survey District, Thames-Coromandel District

PURSUANT to section 20 of the Public Works Act 1981, the Minister
of Works and Development hereby declares that, an agreement to
that effect having been entered into, an easement in gross over the
land described in the First Schedule hereto is hereby acquired for
water supply purposes vesting in the Thames-Coromandel District
Council (hereinafter called “The Council”) the rights set out in the
Second Schedule hereto, subject to the conditions set out in the
Third Schedule hereto on the 20th day of November 1986.

FIRST SCHEDULE

SOUTH AUCKLAND LAND DISTRICT

Land Affected

ALL that piece of land situated in Block XIV, Whitianga Survey
District, being part Lot 34, D.P.S. 37570; as shown marked “E”
on S.O. Plan 53994, lodged in the office of the Chief Surveyor at
Hamilton.

SECOND SCHEDULE

Description of Easement

THE rights and powers contained in paragraphs 2 and 5 of the
Seventh Schedule to the Land Transfer Act 1952 provided that:

(i) there shall be added to subparagraph (c) of paragraph 5 after
the words “is caused” in the 15th line thereof the words
“to the owners’ farming operations or”;

(ii) the rights and powers shall endure so long as the Council has
the right under the Water and Soil Conservation Act 1967
or any Act passed in substitution therefor to take water
from the Oturu Stream.

THIRD SCHEDULE

Terms and Conditions

1. The pipeline shall be not less than 600 millimetres below the
   surface of the land or (where the pipeline crosses a farm drain) not
   less than 600 millimetres below such drain.

2. At all points where the pipeline crosses a drain or fenceline
   the Council shall install and maintain painted timber posts as
   markers.

3. The Council shall complete the installations of the pipeline as
   expeditiously as possible.

Land Acquired, Subject to Certain Rights and Restrictions, for
Purposes Incidental to Coal Mining Operations Under Part IV of
the Coal Mines Act 1979 in Block IV, Maramarua Survey
District, Waikato County

PURSUANT to section 20 of the Public Works Act 1981, the Minister
of Works and Development hereby declares that, an agreement to
that effect having been entered into, the land described in the
Schedule hereto is hereby acquired subject:

(i) as to the land firstly described, to the drainage easement
described in certificate S. 651399 and created by transfer
S. 609718, and to coal mining licence H. 583025, South
Auckland Land Registry.

(ii) as to the land secondly described, to the mining rights in
transfer 654470 North Auckland Land Registry, coal mining
licence H. 575023, electricity agreement H. 171240 and
compensation certificate H. 407588, South Auckland Land
Registry,

for purposes incidental to coal mining operations under Part IV of
the Coal Mines Act 1979, and shall vest in the Crown on the 20th
day of November 1986.
