The Abel Tasman National Park Foreshore Control Order 1986

ORDER IN COUNCIL

At Wellington this 28th day of October 1986

Present:
His Excellency the Governor-General in Council

Pursuant to section 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. Title and commencement—(1) This order may be cited as the Abel Tasman National Park Foreshore Control Order 1986.

(2) This order shall come into force on the 1st day of December 1986.

  1. Interpretation—In this order—

“The Act” means the Harbours Act 1950:

“The Director-General” means the Director-General of Lands:

“Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides.

  1. Grant of Control—There is hereby granted to the Director-General for a period of 21 years from the 1st day of December 1986 and ending with the 30th day of November 2007 control of the foreshore described in the Schedule to this order.

  2. Conditions of Grant—The grant of control conferred by clause 3 of this order is subject to the following conditions—

(a) Suitably worded signs shall be erected at main public access ways to the foreshore described in the Schedule to this order indicating that control of the waters has been granted to the Director-General pursuant to section 8A of the Act.

(b) All money received by the Director-General in the performance or exercise of the functions, duties, or powers conferred on it by this order in respect of the foreshore to which this order applies, shall, after the deduction of any expenditure incurred by the Director-General in the performance or exercise of those functions, duties, or powers, be applied to the construction, repair or improvement of facilities in respect of that foreshore and not otherwise.

  1. Powers of the Minister—Subject to section 8A of the Act, the Minister may, in respect of the waters to which this order applies—

(a) By bylaw, do anything which a Harbour Board may do by bylaw under section 232 of the Act:

(b) Appoint harbourmasters, and other officers, and define or limit their powers and duties.


SCHEDULE

All that area of foreshore extending from the north-eastern boundary of the harbour limits of Tarakohe Harbour as described in the New Zealand Gazette, 9 March 1978, No. 15, page 460, to the southern boundary of Block VI, Kaiteriteri Survey District, in the foreshore of all islands, islets and rocks as shown on plan M.D. 16348 held in the office of the Secretary for Transport at Wellington.

SCHEDULE

All that area of waters situated in Tasman and Golden Bays bounded by a line commencing at the intersection of the southern boundary of Block VI, Kaiteriteri Survey District, with the mean high water mark of Sandy Bay and proceeding generally northerly along the mean high water mark of Tasman and Golden Bays to the intersection in Golden Bay of the said mean high water mark with the north-eastern boundary of the harbour limits of Tarakohe Harbour as described in the New Zealand Gazette, 9 March 1978, No. 15, page 460; thence north-westerly along said north-eastern boundary of the said harbour limits to a point 800 metres from the mean high water mark; thence generally south-easterly along a line parallel to and 800 metres distant from the mean high water mark of Golden and Tasman Bays to a point due east of Abel Head; thence generally southerly along a right line to a point 800 metres due east of the easternmost point of Tonga Island; thence southerly along a right line to a point 800 metres due east of Juries Point on Adele Island; thence south-westerly along a right line to a point 800 metres south-east of the easternmost point of Fishermans Island and the production of that line to a point in line with the southern boundary of Block VI, Kaiteriteri Survey District; thence due west to the point of commencement.

The above area is more particularly delineated as a bold black line on plan M.D. 16348 deposited in the office of the Secretary for Transport at Wellington.
