NOTICE is hereby given that the Public Trustee as trustee of the will of John Campbell, late of Gisborne, baker, deceased, has filed in the office of the High Court at Napier an application for approval of a scheme varying the terms of the will under which the John Campbell Benevolent Fund (being the deceased’s residuary estate) is held. Under the will, the John Campbell Benevolent Fund is to be held on perpetual trust to pay the income to the John Campbell Benevolent Fund Committee (as constituted under the will) to be applied by it towards the assistance of poor children attending Gisborne Central School and Te Hapara School, Gisborne.
Under this scheme, the committee will be able to use excess income to assist poor children attending any of the following schools, namely, Awapuni Primary School, Cobham Primary School, Elgin Primary School, Gisborne Intermediate School, Ilminster Intermediate School, Kaiti Primary School, Kahutia Special School, Mangapapa Primary School, Riverdale Primary School, St Mary’s Primary School, Te Wharau Primary School and Waikirikiri Primary School. The committee can also use the excess income to assist poor children attending any State primary school which subsequently opens within the boundaries of Gisborne City or which is closer to the Gisborne City Post Office than any of the named schools. The scheme will also allow certain excess income presently held by the committee to be capitalised.
Copies of the scheme and the report of the Attorney-General thereon may be inspected, free of charge, at the office of the Registrar of the High Court at Napier, or at the office of the District Public Trust, 40 Childers Road, Gisborne. The application has been set down for hearing in the High Court at Napier on 10 November 1986.
Any person desiring to oppose the scheme is hereby required to give notice of his or her intention to do so to the Registrar of the High Court at Napier and to the District Public Trustee at Gisborne and the Attorney-General not less than 7 clear days before the above-mentioned date.
