Informative Programming
In a submission filed on 11 July, Mr Thomas for lTV sought a direction that TV3 be required to produce a draft of any amended schedule it proposes to produce in respect of informative programming. In support Mr Thomas said that he had produced to Mr Spitz a schedule comparing the informative programmes proposed by TV3 and lTV. TV3 disputed the accuracy of the schedule but offered to produce the correct figures overnight. When produced, most of the figures showed that lTV had either been correct or generous to TV3, said Mr Thomas.
Revised figures were then produced by Mr Thomas but were challenged by Mr Impey who, Mr Thomas said, had indicated TV3 would produce a further schedule. He offered to confer with a view to producing an agreed schedule and he had not heard anything more from Mr Impey.
As TV3 offered to produce a further schedule, Mr Impey could now be required to produce that schedule.
In reply, Mr Impey said that the only schedule presented to Mr Spitz in cross-examination by Mr Thomas, was entitled "Programmes Produced - Above-the-line Costs". He then proceeded to file a statement of TV3's position prepared by Mr Parkinson.
However, Mr Thomas pointed out that he had made a mistake in that he had referred to the wrong witness and should have referred to Mr Bennet.
The matter was raised later orally before us and Mr Impey said that the matter was dealt with in the transcript, but the TV3 programme mix charts were unchallenged by lTV and that the answers were there and in the transcript. Mr Thomas apparently had failed to take account, said Mr Impey, of the answers given in cross-examination.
In reply, Mr Thomas said he could not see why the schedule could not be prepared and had attempted to agree, but nothing had been forthcoming.
The Tribunal has read the transcript, refreshed its memory and has decided it does not require any further assistance by way of a further schedule or memorandum from TV3.
If TV3 had chosen to file it, it would have been acceptable, but the Tribunal itself does not require it to be filed.
