Declaring Land to be Crown Land

ORDER IN COUNCIL

At Wellington this 21st day of July 1986

Present:
His Excellency THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.

Whereas by deed of grant, dated the 1st day of June 1875, the land described in the Schedule hereto, was granted to the Superintendent of the Province of Otago under the Public Reserves Acts 1854 and 1862 in trust for the establishment and maintenance of a University in the City of Dunedin in the Province of Otago, and of public schools in different parts of the province and for the more general advancement of education in the said province

And whereas by section 9 of the Abolition of Provinces Act 1875, the said land was vested in Her Majesty the Queen, in trust for the aforesaid purposes

And whereas the said land is not required for the purposes for which it is held

Now therefore pursuant to section 15 (5) of the Education Lands Act 1949, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby declares that the land in the Schedule hereto shall, as from the date hereof, be Crown land subject to the Land Act 1948 freed and discharged from every educational trust affecting the same.

Otago Land District—Bruce County
1012 square metres, more or less, being Section 6, Block VIII, Town of Waipahi. All certificate of title 20/1 cancelled. Part X Document 12361. S.O. Plan 15026.

The Rotorua District Council Lakeshore, Lakebed, Riverbed and Waters Control Order 1986

His Excellency THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to sections 8A and 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. Title and commencement—(1) This order may be cited as the Rotorua District Council Lakeshore, Lakebed, Riverbed and Waters Control Order 1986.

(2) This order shall come into force on the 1st day of October 1986.

  1. Interpretation—In this order—

“The Act” means the Harbours Act 1950;

“The Council” means the Rotorua District Council constituted under the Local Government Act 1974;

“Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides.

  1. Grant of Control—There is hereby granted to the council for a period of 21 years from the 1st day of October 1986 and ending with the 30th day of September 2007 control of the lakeshore, lakebed, riverbed and waters described in the Schedule to this order.

  2. Conditions of Grant—The grant of control conferred by clause 3 of this order is subject to the following conditions—

(a) Suitably worded signs shall be erected at main public access ways to the lakeshore, lakebed, riverbed and waters described in the Schedule to this order indicating that control of them has been granted to the council pursuant to sections 8A and 165 of the Act.

(b) All money received by the council in the performance or exercise of the functions, duties, or powers conferred on it by this order in respect of the lakeshore, lakebed, riverbed and waters to which this order applies, shall, after the deduction of any expenditure incurred by the council in the performance or exercise of those functions, duties, or powers, be applied to the construction, repair or improvement of facilities in respect of that lakeshore, lakebed, riverbed and waters and not otherwise.

  1. Powers of Council—Subject to section 8A of the Act, the council may, in respect of the lakeshore, lakebed, riverbed, and waters to which this order applies—

(a) By bylaw, do anything which a Harbour Board may do by bylaw under section 232 of the Act.

(b) Appoint harbourmasters, and other officers, and define or limit their powers and duties.

  1. The Orders in Council made on 1 July 1968, New Zealand Gazette, 11 July 1968, page 1165, and 28 April 1975, New Zealand Gazette, 15 May 1975, page 1082, granting control of the waters and lakebed are hereby revoked.

SCHEDULE

ALL the lakeshore, lakebed and waters of the lakes within the District of Rotorua and including the Ohau Channel, the Tarawera River for a distance of 805 metres downstream from Lake Tarawera, the Kaituna River downstream to the footbridge across the same between State Highway No. 30 and Okere Road, and the area of the Waikato River and its tributaries from the Ohakuri Dam to the confluence of the Puehu Stream and the Waikato River, the Puehu Stream from Hamurana Springs to Lake Rotorua and the Waiteti Stream from the bridge in Ngongotaha Road to Lake Rotorua and the lakeshore and the bed of such lakes to a distance of 20 metres from the edge of the lakes at ordinary lake level; or in respect of waters or lakeshore or lakebed now or hereafter used for hydro-electric purposes, at the maximum design operating level excepting thereout the bed of Lake Okataina and including therein the waters of Lake Rotoma adjoining the Whakatane District boundary.

Pursuant to section 59 of the Defence Act 1971, the Minister of Defence hereby approves the following appointments, promotions, extensions, relinquishments, transfers, resignations and retirements of Officers of the New Zealand Cadet Forces

Appointments

Donald Alexander McGhee is appointed to a Cadet Commission in the rank of Ensign on probation with effect 19 May 1986, seniority 19 May 1986.

Donald Bruce Wills is appointed to a Cadet Commission in the rank of Ensign on probation with effect 12 June 1986, seniority 12 June 1986.

Lieutenant S. H. J. Ensor is appointed Unit Commander of TS Steadfast with effect 6 May 1986.

Promotions

The following officers are promoted to the rank and with seniority from the dates shown:
