FOURTH SCHEDULE

THE New Zealand Refining Company Limited shall not be liable to pay for or contribute towards the expense of erection or maintenance of any fence between any land described herein and any contiguous land owned by the said company but this proviso shall not enure for the benefit of any subsequent purchaser of the contiguous land.

Land, and Easements Over Land, Acquired for Waterworks in Block XII. Rotoiti Survey District, Rotorua District

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, agreements to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for waterworks, the pipeline easement described in the Second Schedule hereto is hereby acquired for waterworks over the land described in the Third Schedule hereto, the right of way easement described in the Fourth Schedule hereto is hereby acquired for waterworks over the land described in the Fifth Schedule hereto, and further declares that the said land and easements shall vest in the Rotorua District Council on the 18th day of September 1986.

Description of Pipeline Easement to be Acquired

IN respect of the land described in the Third Schedule hereto a pipeline easement including the right of entry and re-entry and other rights and powers set out in the Seventh Schedule to the Land Transfer Act 1952 relating to rights to convey water and additional rights attaching to easements of right to convey water.

Declaring an Easement Over Land Acquired for Water Supply Purposes in Block XIII, Whitianga Survey District, Thames-Coromandel District

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, an easement in gross over the land described in the Schedule hereto (right to convey water) is hereby acquired for water supply purposes (which may be surrendered by notice in the Gazette) and shall vest in The Thames-Coromandel District Council on the 18th day of September 1986 such grant being in accordance with the powers and rights set out in clauses 2 and 5 of the Seventh Schedule of the Land Transfer Act 1952, with the following modification: there shall be added to paragraph (c) of clause 5 after the words “is caused” (in the fifteenth line thereof) the words “to the owners’ farming operations or”, provided that (1) the pipeline is to be not less than 600 millimetres below the surface of the land or (where the pipeline crosses a farm drain) not less than 600 millimetres below such drain (2) at all points where the pipeline crosses a drain or fenceline the council shall install and maintain painted timber posts as markers.
