Moore), gives notice of the receipt of the following application and will hold a public sitting in the District Court, Blenheim on Friday, 21 February 1986, commencing at 2 p.m. to hear evidence for or against granting it.

The Water Recreation (Westport Harbour) Notice 1986

I, Beryl Ann Ranger, Senior Executive Officer (Harbours and Foreshores) of the Ministry of Transport, pursuant to regulation 20(1) of the Water Recreation Regulations 1979 that power being delegated to me pursuant to sections 8 and 9 of the Ministry of Transport Act 1968, hereby give the following notice.

NOTICE

  1. (a) This notice may be cited as the Water Recreation (Westport Harbour) Notice 1986.

(b) This notice shall come into force on the date of its publication in the New Zealand Gazette and it shall remain in force until revoked by further notice in the Gazette.

  1. Regulations 7(1)(a), 7(1)(b), 7(2), 8(1)(a), 8(1)(b) and 8(2) of the Water Recreation Regulations 1979, shall not apply to small craft using the area described in the Schedule hereto subject to the following conditions:

(1) Notwithstanding any other provisions of this notice, no person who is permitted by any such provisions to propel or navigate a small craft at a speed through the water exceeding 5 knots shall do so in any manner that is likely to endanger or unduly annoy any person who is in, on or using the water, or fishing or undertaking any recreational activity in the vicinity of the small craft.

(2) All persons in charge of a vessel or when water skiing shall adhere to and keep the provisions of all other acts and regulations not specifically exempted by this notice.

(3) Notice boards shall be erected at the following places:

(a) Shingle Spit between Fonblanque and Rintoul Streets known as Tredinnicks Point;

(b) Harbourmaster’s office;

(c) Fishermen’s Wharf;

(d) Russell Street (northern end);

(e) Shingle Beach.

  1. Suitable notices as may be approved by the Regional Secretary, Ministry of Transport, Christchurch, shall be erected at such other sites as are deemed necessary by the Regional Secretary.

  2. Small craft, with or without water skiers, must give way to all other ships, which include the dredgers and the tug at all times.

The Water Recreation (Westport Harbour) Notice 1970* is hereby revoked.

SCHEDULE

ALL the waters of Westport Harbour, excepting the Fishing Lagoon, the Shingle Beach, the Western Lagoon, and the Western Swell Compartment with the exception of the area shown cross hatched on plan M.D. 16376 where water skiing is permitted.

(2) All persons in charge of a vessel shall adhere to and keep the provisions of all other Acts and regulations not specifically exempted by this notice.

(3) The provisions of the General Harbour (Nautical and Miscellaneous) Regulations 1968 (1968/239) shall, so far as applicable, apply at all times.

  1. A suitable notice as may be approved by the Regional Secretary, Ministry of Transport, Christchurch, shall be erected at sites deemed necessary by the Regional Secretary.

  2. The Water Recreation (Westland Rivers) Notice 1977* is hereby revoked.
