(3) the supply of labels for use on retail store shelves indicating suggested retail prices, subject to the condition that whenever the documents (1) to (3) above are issued the company will notify its member retailers in writing that:
"Any resale price or margin or conditions of sale set out or indicated herein are suggestions only. Other prices may be charged, and other conditions of sale may be imposed, in relation to the goods to which the price or margin or conditions of sale relate, without the risk of the issuer of this notice or the supplier of the goods applying sanctions of any kind."
DECISION NO. 124
By this decision dated 17 April 1985, the Commission consented to the merger or takeover proposal whereby Brierley Investments Limited may acquire more than 50 percent of the issued share capital of Consolidated Metal Industries Limited subject to the condition that:
"In respect of the sale of goods by it Consolidated Metal Industries Ltd. shall not discriminate between any purchasers of the same class acquiring such goods in similar quantities under similar conditions of purchase [except solely on identifiable economic grounds] or between purchasers of the same class outside the CMI group acquiring such goods in similar quantities and under similar conditions of purchase."
DECISION NO. 125
By this decision dated 16 April 1985, the Commission consented to the merger or takeover proposal whereby Dalgety Crown Limited might acquire the 50 percent shareholding it does not already own in HBF Dalgety Limited. A further decision with reasons will be issued in relation to this proposal.
