CALL FOR TENDERS: ROUND 23
PURSUANT to the Import Control Regulations 1973, Amendment No. 3 (S.R. 1980/246), and within the terms of the Australia - New Zealand Closer Economic Relations Trade Agreement (ANZCER:TA), the Secretary of Trade and Industry, acting under delegated authority, is calling tenders for import licences (Tendered Exclusive Australian Licences or TEALs) for the goods specified below.
The instructions for tenderers for ANZCER:TA tenders and the general terms and conditions which apply to the submission and acceptance of tenders are set out in the Guide To Global Import Licence Tendering, published November 1984, and modified by the TEAL And MEAL Allocation Procedures, published in March 1985. Tenderers should note that while in general the rules for global licence tendering also apply to ANZCER:TA tenders, some rules, including some important ones, differ. Both guides should be studied carefully before tender bids are lodged.

- This supplement to the New Zealand Gazette will be sent to all persons and organisations on the Register of Tenderers. Prospective tenderers not on the Register of Tenderers can purchase the Gazette at the bookshops of the Government Printer. Registered tenderers will also be sent bid forms and copies of guide notes for tendering. Other persons can obtain these from Collectors of Customs and the Department of Trade and Industry. Application forms for entering on to the Register of Tenderers can be obtained from the Department of Trade and Industry.
DEADLINE
- TENDERS CLOSE AT 5 P.M. ON MONDAY, 27 MAY 1985, WITH THE REGISTRAR, IMPORT LICENCE TENDERING, DEPARTMENT OF TRADE AND INDUSTRY, P.O. BOX 3146, WELLINGTON. NO LATE TENDERS CAN BE ACCEPTED. Tenders must be mailed to the above address in time to arrive before the closing time or delivered by hand to the First Floor Reception, Bowen State Building, Bowen Street, Wellington. Hand deliveries may be made between 8.30 a.m. and 5 p.m. Monday to Friday, except public holidays. Bid forms can be mailed using the Bureaufax Service of the G.P.O.. Telex and telegram bids will NOT be accepted. Envelopes should be clearly marked "ANZCER:TA Import Licence Tender" on the bottom right-hand corner.
BID FORMS
- The bid forms to be used are printed on buff coloured paper. They are the same forms as are used for global import licence tenders. Old style bid forms used in earlier tender rounds must not be used. Old forms were on pink paper for ANZCER:TA tenders and blue paper for global licence tenders. Anyone who has retained such forms should destroy them.
MEAL HOLDERS
- A manufacturer, including its subsidiaries and associates, who receives a share of the Manufacturers Exclusive Australian Licences (MEALs) in an item code is not permitted to tender in the same item code. For further details, please refer to the TEAL And MEAL Allocation Procedures.
TENDER AMOUNTS

Licences are tendered in units of $2,000. The amounts shown for tender are the numbers of $2,000 units. Tenderers may bid for all or any number of the units available. All Licences won by a tenderer in each tender number will be aggregated into one licence. One invoice will similarly be issued for each tender number to successful bidders for the amount of the premium due for that tender number.

The amounts shown for tender are minimum amounts and may be increased. This supplement to the New Zealand Gazette also contains the call for applications from manufacturers for the new 1985/86 Manufacturers Exclusive Australian Licences (MEALs). An amount is available in most categories. The call for MEAL applications closes 2 weeks before the call for tenders closes. Any amount not taken up by manufacturers from the new MEAL allocations will be added to the amounts for tender. A tenderer wishing to obtain the maximum amount of licence may tender for up to the combined TEAL and MEAL amounts (in which case the MEAL amount should be divided by 2000 to convert to tender units).
CLASSIFICATION OF GOODS

Tenders are by Import Licensing Schedule item code classifications. In some cases item codes are split into two or more tender numbers or combined with other item codes into one tender number. A brief description of the goods being tendered is given to assist tenderers but is not intended to be definitive. For a full identification of the goods concerned tenderers should refer to the Import Licensing Schedule and the Customs Tariff and should consult the Department of Trade and Industry or the Customs Department. It is the responsibility of the tenderer to confirm the correct classification of the good he or she wishes to import.

Some item codes contain tariff items that are exempt from the requirements of import licences, or are subject to licence on demand, when of Australian origin. Both categories are detailed in the Import Licensing Schedule. TEALs can not be used for these goods. No licence is required to import exempt goods. Licences for goods subject to licensing on demand are issued on application to the Collectors of Customs.

The Import Licensing Schedule provides in some item codes that licences will be endorsed as not available for some goods in that item code (of a type made in New Zealand). These endorsements do not apply to ANZCER:TA Licences. TEALs may be used to import these goods. All exclusions from the item code coverage applying to ANZCER:TA licences are detailed in full as part of the brief description given here (and will be printed on licences when issued.)
OTHER STATUTES AND REGULATIONS
- The granting of an import licence does not relieve the licence holder of any responsibility to meet the requirements of other statutes, regulations, standards, etc. Tenderers should be conversant with the requirements for the importation and sale of goods being tendered.
MOTOR VEHICLES AND COMPONENTS

Access arrangements for most motor vehicles and parts for motor vehicles are provided for by the Motor Vehicle Industry Plan. ANZCER:TA TEALs cannot be used to import these goods. Licences for item codes in which motor vehicle parts fall will have their product coverage endorsed "excluding those of a kind commonly used with the vehicles specified in appendix B attached". A copy of Appendix B will be attached to relevant licences. It reads:

Pursuant to Annex C of the ANZCER Trade Agreement, in the item codes listed below the Exclusive Australian Licences are only available for goods EXCLUDING components of a kind commonly used with:
(a) Tractors for articulated vehicles, being tractors that are designed for operation solely or principally on the highway; or
(b) Vehicles of Tariff Heading 87.02, other than air-cushioned vehicles or assembled convertible road rail motor coaches. -
