  1. Any notice to be given to the Electrical Supply Authority shall be sufficient if sent by registered post to the offices of the Electrical Supply Authority.

  2. Any notice to be given on the part of the Minister of Energy shall be sufficient if given in writing signed by the Minister or by any person purporting to act on behalf of or under the authority of the Minister.

  3. Any notice to be given to the Minister of Energy shall be sufficient if given in writing to or sent by registered post letter addressed to the Secretary of Energy, Ministry of Energy, Wellington.

  4. This licence shall not be construed as granting a consent to generate electricity pursuant to section 25 of the Electricity Act 1968.

  5. This licence shall come into force on the 1st day of April 1985 and shall continue in force for a period of 21 years from that date unless it is sooner lawfully determined in accordance with clauses 8 or 9 hereof.

  6. The Governor-General in Council may pursuant to section 22 of the Electricity Act 1968 cancel this licence if the Electrical Supply Authority is in breach of the provisions contained in clause 2 of these conditions.

  7. This licence may be cancelled by the Minister of Energy at the request of or with the consent of the Electrical Supply Authority.

  8. At the expiry or cancellation of this licence, the Electrical Supply Authority shall as required by notice in writing by the Minister of Energy remove all buildings, poles and other erections and all transmission lines, plant and other machinery and other removable equipment authorised by the licence to be erected, installed or provided and if within 12 months after being so required the Electrical Supply Authority fails or neglects to remove the same, then the same shall, without payment of any compensation vest in and become the property of the Crown and it shall be lawful for any person authorised by the Minister of Energy in that behalf, subject to compliance with section 15A of the Electricity Act 1968 to enter upon any land or premises and take possession of and remove the same or any part thereof.

  9. Nothing contained in the licence, either expressly or by implication shall be deemed to authorise the Electrical Supply Authority to erect, construct or maintain any lines or works except subject to such conditions (not inconsistent with this licence) as may from time to time be lawfully imposed by any local authority within the district of which any such lines or works may be situated.

  10. The systems of supply shall be as described in paragraphs (a), (b), (c), (d), (e) and (f) of regulation 13 of the Electrical Supply Regulations 1984.

  11. The Electrical Supply Authority shall 6 months prior to the expiry of the term of this licence provided in clause 7 herein, make written application to the Minister of Energy for the granting of a new licence.

SCHEDULE

AREA OF SUPPLY

All that area in the Nelson, Westland, and Otago Land Districts bounded by a line commencing at Trig. Station YZ, Awarua Point, in Block XII, Awarua Survey District and proceeding north-easterly generally along the sea coast to the south-western corner of Section 15, Block V, Brighton Survey District; thence easterly along the northern boundary of Blocks IX, X, XI, and XII Brighton Survey District, to the summit of the Paparoa Range; thence generally north-easterly along that range passing through Mounts Priestly, Faraday and Uriah to Trig. Station B.B., Berlins Bluff; thence northerly along a right line to the south-eastern corner of Section 54, Block VIII, Ohika Survey District westerly and northerly along the southern and western boundaries of the said section to the southern boundary of Section 1, Block VIII, Ohika Survey District. Westerly and northerly along the southern and western boundaries of said section 1, and the last-mentioned boundary produced to the middle of the Buller River; thence north-easterly generally up the middle of that river to its intersection with the northern boundary of Block IV, Inangahua Survey District, being a point opposite the south-western corner of Section 2, Block I, Inangahua Survey District; thence easterly along the western boundary of Block III aforesaid and to northerly along the western boundary of Block XVI, Orikaka Survey District to a point due west of the northern boundary of Section 2, Block XVI, aforesaid. From that point on the western boundary of Block XVI aforesaid, easterly along a right line to and along the northern boundary of said Section 2 and its production to the middle of New Creek; thence northerly up the middle of New Creek to a point in line with the northern boundary of Section 17, Block XVI, Orikaka Survey District; thence easterly to and along that boundary to its easternmost point; thence generally southerly and westerly along the eastern and southern boundaries of the said Section 17 and southerly along the eastern boundaries of Section 16 and Section 13, Square 139, Block XVI, aforesaid to the southernmost corner of the said Section 13; thence easterly along a right line to the northernmost corner of Section 9, Square 139, situated in Block XIII, Lyell Survey District; again easterly along the northern boundaries of the said Section 9 and Scenic Reserve No. 5 to its easternmost point; thence southerly along the eastern boundary of the said scenic reserve to the northern boundary of Block I, Maruia Survey District; thence easterly along the northern boundaries of the said Block I and Block II, Maruia Survey District to a spur that runs between Bald Hill and the mouth of the Eight Mile or Boundary Creek; thence generally south-easterly along the said spur to the mouth of the said creek; thence due south, to the summit of the Brunner Range; thence generally along the summit of that range passing through Mount Curtis, Mount Wynn and Mount Felton to the western boundary of Block II, Burnett Survey District; thence southerly along the western boundaries of the said Block II, Blocks VI, X and XIV, Burnett Survey District, Blocks II, VI, X and XIV, Rahu Survey District and Block II, Lewis Survey District to the northern boundary of Part 1807 (Pohaturoa State Forest 28), Block II, Lewis Survey District; thence south-easterly along that boundary to Mount Alexander; thence in a right line between the said mount and a point on the western side of Palmer Road approximately 300 metres north of the southern boundary of Section 7, Block III, Lewis Survey District; southerly down the western side of Palmer Road to and along the southern boundary of said Section 7 and Section 20, Block III, Lewis Survey District to the western boundary of Section 1, Block VII, Lewis Survey District; southerly and easterly along the western and southern boundaries of said Section 1, and the last-mentioned boundary produced in a right line across the intervening public road to the south-western corner of Section 2, Block VII aforesaid; south-easterly along the southern boundary of said Section 2 to and along a right line produced to the northern boundary of Part R1807 (Waiheke State Forest 29), Block VII, Lewis Survey District; thence generally easterly along the aforesaid boundary to the summit of the main divide being in Block IX, Boyle Survey District; thence south-westerly generally along the summit of the said main divide to a peak known as Popes Nose in Matukituki S.D.; thence south-westerly generally along the summit of the Southern Alps, through Avalanche Peak, Mount French, Mount Joffre, Mount Bevan, Mount Barff, Mount Liverpool, Mount Maori, Mount Maoriri, The Snowman, Mount Lydia, Mount Tiber and Mount Ian to Albert Peak; thence northerly along the range confining the western side of the Olivine Ice Plateau, through the peaks: Gates, Intervention, The Tower, Ark, Darkness Peak and Mount Temple to Typhoon Peak; thence north-westerly generally to and along the ridge dividing the watersheds of Limbo Stream and the Red Pyke River through Simonin Pass to Red Mountain thence north-easterly generally along the summit of the Red Hill Range to the summit of the ridge that divides the catchments of Durwards Creek and Jerry River; thence westerly generally along the said ridge through Trig. Station YO, Telescope Hill, over Pyke Saddle to Trig. Station YQ, Mount Beck, a peak on the summit of the McKenzie Range; thence south-westerly along the summit of the said range to the point of commencement.

The said area being more particularly shown outlined in black on the plan numbered NZE 2079 (sheets 1–28) deposited in the office of the Electricity Division of the Ministry of Energy at Wellington.

Hamilton City Council Electricity Supply Licence

  1. Robert James Tizard, Minister of Energy, acting pursuant to section 20 of the Electricity Act 1968 hereby license Hamilton City Council hereinafter called the Electrical Supply Authority to supply electricity, and to lay, construct, put up, place and use all electric lines and works which may from time to time be required for the distribution and supply of electricity within the area specified in the Schedule hereto.

This licence is issued subject to the following conditions:

CONDITIONS

  1. This licence may be cited as the Hamilton City Council Electricity Supply Licence 1985.

  2. The Electrical Supply Authority shall comply with the provisions of this licence, the Electricity Act 1968 and all enactments made in amendment of or substitution for that Act, any Electrical Codes of Practice made under that Act, the Electrical Supply Regulations 1984, the Electrical Wiring Regulations 1976 and all regulations made in amendment of or substitution for any of those regulations.

  3. Any notice to be given to the Electrical Supply Authority shall be sufficient if sent by registered post to the offices of the Electrical Supply Authority.
