  1. Any notice to be given to the Minister of Energy shall be sufficient if given in writing to or sent by registered post letter addressed to the Secretary for Energy, Ministry of Energy, Wellington.

  2. This licence shall not be construed as granting a consent to generate electricity pursuant to section 25 of the Electricity Act 1968.

  3. This licence shall come into force on the 1st day of April 1985 and shall continue in force for a period of 21 years from that date unless it is sooner lawfully determined in accordance with clauses 8 or 9 hereof.

  4. The Governor-General in Council may pursuant to section 22 of the Electricity Act 1968 cancel this licence if the Electrical Supply Authority is in breach of the provisions contained in clause 2 of these conditions.

  5. This licence may be cancelled by the Minister of Energy at the request of or with the consent of the Electrical Supply Authority.

  6. At the expiry or cancellation of this licence, the Electrical Supply Authority shall be required to remove all buildings, poles and other erections and all transmission lines, plant and other machinery and other removable equipment authorised by the licence to be erected, installed or provided and if within 12 months after being so required the Electrical Supply Authority fails or neglects to remove the same, then the same shall, without payment of any compensation vest in and become the property of the Crown and it shall be lawful for any person authorised by the Minister of Energy in that behalf, subject to compliance with section 15A of the Electricity Act 1968 to enter upon any land or premises and take possession of and remove the same or any part thereof.

  7. Nothing contained in this licence, either expressly or by implication shall be deemed to authorise the Electrical Supply Authority to erect, construct or maintain any lines or works except subject to such conditions (not inconsistent with this licence) as may from time to time be lawfully imposed by any local authority within the district of which any such lines or works may be situated.

  8. The systems of supply shall be as described in paragraphs (a), (b), (c), (d), (e), (f), (h) and (j) of regulation 13 of the Electrical (Supply) Regulations 1938. The system of supply authorised under paragraph (j) aforesaid shall be a single-conductor earth-return system of 11 000 volts between conductor and earth, and the use thereof shall be subject to such terms and conditions as are from time to time laid down by the Deputy Secretary of the Electricity Division of the Ministry of Energy.

  9. The Electrical Supply Authority shall, 6 months prior to the expiry of the term of this licence provided in clause 7 herein, make written application to the Minister of Energy for the granting of a new licence.

SCHEDULE

AREA OF SUPPLY

All that area in the Wellington Land District bounded by a line commencing on the sea coast at Turakirae Head in Block IX, Pencarrow S.D. and proceeding generally north-easterly along a right line to Trig. Station A.A. (Waitaruanui) and along the summits of the Rimutaka and Tararua Ranges to Mount Dundas in Block XI, Tararua S.D. and along a right line towards Trig. Station Awarua in Block I, Tararua S.D. to its intersection with a right line bearing 297° from Trig. Station Tawhero in Block XIII, Tarana S.D.; thence south-easterly along that right line to Trig. Station Tawhero and along the summit of the Tawhero Range to the north-western boundary of Section 9, Block IV, Mikimiki S.D.; thence south-westerly along that boundary and its production to the middle of the Ruamahanga River, thence generally south-easterly along the middle of that river to a point in line with the north-western boundary of Section 71, Opaki District in Block VIII, Mikimiki S.D., to and along that boundary and the north-eastern boundary of that section, and along its south-eastern boundary for a distance of 293.3 metres and along a right line to the westernmost corner of Section 69, Opaki District, being a point on the southern boundary of Lot 6, D.P. 16214; thence generally north-easterly along that boundary and the eastern boundary of that lot and along the southern boundary of Section 25, Block V, Kopuaranga S.D. and its production to the eastern side of Jacksons Line, along that side to and along the southern boundary of Section 28, Block V, aforesaid and its production to the middle of the Kopuaranga River, up the middle of that river to a point in line with the southern boundary of Section 51, Rangitumau District; to and along that boundary and the eastern boundary of that section, crossing Dorsets Road along the southern boundary of Section 100, Block V, aforesaid, the western and northern boundaries of Lot 1, D.P. 14895, a right line across a public road and along the northern boundaries of Lot 2, D.P. 14895, Lot 1, D.P. A/2167, and Lot 1, D.P. A/1146 and its production to the eastern side of Southeys Road; thence generally southerly along that side to the southern boundary of Section 45, Block II, Kopuaranga S.D.; thence generally south-easterly along that boundary, the western and southern boundaries of part Section 208, Rangitumau District, and the production of the last-mentioned boundary to the eastern side of No. 52 State Highway; thence along that side to the road corner eastward of L.T. XXXVIII on S.O. 24544, thence along a right line to a point in line with the western boundary of Lot 2, D.P. 3243 and 221.3 metres southward from the south-western corner of that Lot, along a right line to that corner, along the south-western boundaries of the said Lot 2 and Lot 1, D.P. A/345 to the south-eastern boundary of that lot; thence generally northerly along that boundary and its production to the northern side of Clelands Road, along that side to and along the eastern boundary of Section 108, Rangitumau District, to the southern boundary of Section 110, Rangitumau District; thence generally south-easterly along that boundary and a right line across Mangaone Road to and along the south-western boundary of part Section 235, Rangitumau District, to the eastern boundary of that section; thence generally north-easterly along that boundary and the eastern boundary of Section 139, Rangitumau District, to and along the south-eastern, south-western and north-western boundaries of Lot 1, D.P. 4826, a right line across Waitiri Road to and along the north-western and north-eastern boundaries of Lot 2, D.P. 4826, the north-western boundaries of said Lot 2, Lots 1 and 2, D.P. 17545, Lot 3, D.P. 9135, Section 24, Rangitumau District, crossing a public road and Lot 1, D.P. 9135 to the south-western boundary of Section 237, Rangitumau District in Block 1, Mangaopari S.D.; thence generally south-easterly along that boundary and a right line from the southeastern corner of that section to the northernmost corner of Section 148, Whareama District, along the south-eastern boundary of Lot 4, D.P. 2131 and the north-eastern boundary of Lot 2, D.P. 20290 and its production to the middle of Tauweru River; thence generally north-easterly up the middle of the river to a point in line with the south-western boundary of Section 823, Whareama District; thence generally easterly to and along that boundary and the generally southern boundary of that section to its eastern boundary thence generally north-easterly along that boundary and the eastern boundary of Section 10, Block XVIII, to the south-eastern corner and along right lines bearing 190° 46' 8" distance 20.1 metres 144° 36' 38" distance 534.8 metres and 161° 02' 43" distance 902.8 metres to the northern boundary of Block XVI, Puketoi S.D.; thence easterly along that northern boundary to and down the middle of the Mataikona River to the sea coast; thence generally south-westerly along the sea coast to the point of commencement.

The said area being more particularly shown outlined in black on the plan numbered NZE 2077 (sheets 1, 2, 3, 4, 5, 6, 7, 8 and 9) deposited in the office of the Electricity Division of the Ministry of Energy at Wellington.

West Coast Electric Power Board Electricity Supply Licence 1985

I, Robert James Tizard, Minister of Energy, acting pursuant to section 20 of the Electricity Act 1968 hereby license West Coast Power Board hereinafter called the Electrical Supply Authority to supply electricity, and to lay, construct, put up, place and use all electric lines and works which may from time to time be required for the distribution and supply of electricity within the area specified in the Schedule hereto.

This licence is issued subject to the following conditions:

CONDITIONS

  1. This licence may be cited as the West Coast Electric Power Board Electricity Supply Licence 1985.

  2. The Electrical Supply Authority shall comply with the provisions of this licence, the Electricity Act 1968 and all enactments made in amendment of or substitution for that Act, any Electrical Codes of Practice made under that Act, the Electrical Supply Regulations 1938, the Electrical Wiring Regulations 1976 and all regulations made in amendment of or substitution for any of those regulations.
