ALL that piece of land containing 1 rood 17 perches, situated in Block II, Tokatoka Survey District, Auckland R.D. and being part Lot 3, D.P. 23854, and being part Allotment 13, Parish of Arapohue; as the same is more particularly delineated on the plan marked M.O.W. 4385 (S.O. Plan 43149) deposited in the office of the Minister of Works and Development at Wellington, and thereon coloured yellow.

FOURTH SCHEDULE

NORTH AUCKLAND LAND DISTRICT

  1. THE grantee shall have from time to time and at all times the full, free, uninterrupted and unrestricted right, liberty and privilege from time to time and at all times;

(a) To transmit electric current through, in, over, across, along or under the stipulated course;

(b) To lay, place, construct, inspect, service, maintain and renew a line of overhead electricity transmission wires or underground electric wire cables through, in, over, across, along or under the stipulated course;

(c) To enter upon the stipulated course by her servants, agents, engineers and workmen with or without any necessary vehicles, implements, tools and materials of any kind for the purpose of laying, placing, constructing, inspecting, servicing, maintaining and renewing the line of overhead electricity transmission wires or underground electric wire cables and opening up the soil thereof as necessary to carry out such work;

(d) To take, draw, pump, convey and lead water by means of a line of water supply pipes and related fittings, fixtures, pumps and meters through or under the stipulated course;

(e) To lay, place, construct, service, maintain and renew a line of water supply pipes and related fittings, fixtures, pumps and meters through, on or under the stipulated course;

(f) To enter upon the stipulated course by her servants, agents, engineers and workmen with or without any necessary vehicles, implements, tools and materials of any kind for the purpose of laying, placing, constructing, servicing, maintaining and renewing the line of water supply pipes and related fittings, fixtures, pumps and meters and opening up the soil thereof as necessary to carry out such work.

  1. The grantor shall have the right to connect to the aforesaid line of water supply pipes subsidiary lines of water supply pipes for the purpose of supplying water to the grantor's property.

  2. The grantor shall be responsible for:

(a) Installing, maintaining, repairing and renewing the water supply pipeline and such pipe shall have a minimum internal diameter of 30 millimetres;

(b) Maintaining, repairing and renewing the pump intake structure and associated walkway;

(c) Maintaining and repairing the earth dam and adjacent pond area and shall maintain the pond to maximum capacity by periodic removal of accumulated silt and debris;

(d) The payment for all electricity consumed in operation of the water supply pump. However, at intervals of no more than 6 months the grantee shall reimburse the grantor for that portion of the electricity consumed by the grantee.

  1. The grantee shall be responsible for installing, maintaining, repairing and renewing the water supply pump and such pump shall have a minimum pumping capacity of 500 gallons per hour.

  2. The grantee shall discontinue drawing water from the pond during such period as the water level of the pond falls to or below a level representing 20 percent of the maximum water storage capacity of the pond, such level to be clearly defined by a calibrated marker fixed to the pump intake structure within the pond.

  3. The grantor and grantee shall be equally responsible for maintaining, repairing and renewing the electricity supply line.

Land Acquired for Post Office Purposes (Microwave Station) in Block XI, Purua Survey District, Whangarei County

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for post office purposes (microwave station) and shall vest in the Crown on the 21st day of March 1985.

PURSUANT to the Public Works Act 1981, the Minister of Works and Development hereby:

(a) Declares the piece of road described in the Schedule hereto to be a Government road, and

(b) Stops the said road.

ALL that piece of road containing 589 square metres, situated in Block XV, Drury Survey District, adjoining or passing through part Allotment 9, Pukekohe Parish; as shown marked "A" on S.O. Plan 58964, lodged in the office of the Chief Surveyor at Auckland.
