The Local Water Conservation (Stony (Hangatahua) River) Notice 1985

PURSUANT to the Water and Soil Conservation Act 1967, the Taranaki Regional Water Board publishes the following notice.

NOTICE

1. Title and Commencement—(1) This notice may be cited as the Local Water Conservation (Stony (Hangatahua) River) Notice 1985.

(2) This notice shall come into force on the 14th day after the date of its notification in the Gazette.

2. Interpretation—In this notice, unless the context otherwise requires:

“Act” means the Water and Soil Conservation Act 1967.

“The Protected Waters” means the Stony River, also known as the Hangatahua River, its associated tributaries, ponds and tarns, from its source at, or about map reference NZMS1 sheet N118 628 700, to its entry to the Tasman Sea at, or about map reference NZMS1 sheet N108 412 775.

3. Outstanding Characteristics and Features—It is hereby declared that the protected waters include and provide for regionally important:

(a) fisheries and angling features;

(b) scenic characteristics and recreational features; and

(c) cultural, historical and educational features.

4. Retention of Natural Waters in Natural State—Because of the characteristics and features specified in clause 3 of this notice:

(a) the quantity and rate of flow of natural water in the Stony River and its tributaries shall be retained as far as possible in their natural state; and

(b) the quantity and level of natural water in the ponds and tarns forming part of the protected waters shall be retained as far as possible in their natural state.

5. Right to Dam not Granted—A right to dam any river or stream forming part of the protected waters shall not be granted under section 21 of the Act.

6. Water Rights and General Authorisations—(1) Subject to the exemptions in subclause 2 of this clause no water rights under section 21 or 24 of the Act may be granted by the Regional Water Board and no general authorisation under section 22 of the Act may be made by the Regional Water Board in respect of the protected waters where the effect of such rights or authorisations would be that the provisions of this notice cannot remain without change or
