Land Declared to be Road and Road Stopped in Block V, Rangitaiki Upper Survey District, Whakatane District

PURSUANT to Part VIII of the Public Works Act 1981, the Minister of Works and Development:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road, and vested in The Whakatane District Council.

(b) Pursuant to sections 116 and 117, declares the portions of road described in the Second Schedule hereto to be stopped and further declares that:

(i) The areas marked “C” and “G” on S.O. Plan 52411, now known as Sections 39 and 40, Block V, Rangitaiki Upper Survey District shall be amalgamated with the land in certificate of title No. 21A/1268, subject to memoranda of mortgage S. 360832, H. 127910.1 and H. 038446.3, South Auckland Land Registry.

(ii) The areas marked “D” and “H” on S.O. Plan 52411, now known as Sections 41 and 42, Block V, Rangitaiki Upper Survey District shall be amalgamated with the land in certificate of title No. 29A/488, subject to memoranda of mortgage H. 467934.2, H. 601911.1, H. 467934.4 and H. 467934.3, South Auckland Land Registry.
