(viii) The Awakino River and its tributaries from its source to the Mahoenui Bridge;

(ix) The Little Waipa River from its source to its point of entry into Lake Karapiro;

(l) any multiple hook in the Wanganui River;

(m) any unsportsmanlike device or method.

  1. Prohibition on unauthorised fishing tackle, etc.—No licence holder shall, when fishing for acclimatised fish, use or have in his possession or under his control or convey or cause to be conveyed to the vicinity of any place where he is fishing or proposes to fish, any paravane, any stroke-hauling or foulhooking gear, or any spear.

  2. Use of nets.—Subject to clause 6 (1) of this notice, no licence holder shall use or cause to be used for taking any acclimatised fish, a net of any description:

Provided that it shall be a defence for any person charged with a breach of this clause if he proves that he was netting for indigenous fish in accordance with the provisions of any regulations or notices in force in that behalf.

  1. Prohibition on possession or control of spear gun—(1) No licence holder shall, when taking any acclimatised fish or when in possession of any acclimatised fish, use or have in his possession or under his control any spear gun or any pointed missile (other than a bullet) which is propelled by means of any mechanical or explosive device.

(2) Where any person is charged with an offence under sub-clause (1) of this clause, it shall be a defence to the charge if the defendant proves that the spear gun or pointed missile in his possession or under his control was not used in taking the acclimatised fish.

(3) In this clause the term “explosive” has the same meaning as in the Explosives Act 1957.

  1. Authorised lures and baits—No licence holder shall fish for acclimatised fish with any bait or lure other than artificial or natural fly, insect, worm, crustacea, minnow, fish (excluding fish ova or any portion of a fish or any shellfish (mollusca)), except in the following waters:

(i) Lake Kuwakatai:

(ii) Lake Kereta:

(iii) Lake Okaoho:

(iv) Lake Pupuke:

(v) Smales Quarry Lake:

(vi) Lake Pukeiti:

(vii) The Mangatawhiri River from the bridge on State Highway 2 its confluence with the Waikato River:

(viii) The Whanganarino River:

(ix) Quarry Road Dam Ardmore:

(x) Panakaura City Water Supply Dam:

(xi) Any other pond or lake contained within any freehold land title: where any fish (excluding fish ova or any portion of a fish or any shellfish (mollusca)) may be used.

  1. Daily limit bag—(1) No licence holder on any one day take or have in his possession more than 8 trout or salmon.

(2) Notwithstanding subclause (1) of this clause no licence holder shall on any one day take or have in his possession more than a total of 5 trout or salmon from one or more of the following waters—

(i) Lake Pupuke:

(ii) Lake Moananu:

(iii) Lake Ototoa:

(iv) Lake Tomarata (Moirs Lake):

(v) Lake Omaperearea (Muirs Lake):

(vi) The Hukutaia Cut:

(vii) Smales Quarry Lake.

(3) No person shall continue to use a rod and running line to take trout or salmon on any day on which he has already taken 8 trout or salmon.

(4) It shall be permissible to make up the difference between a lesser limit bag prescribed in one place and a higher limit bag prescribed in another place.

  1. Minimum size to be taken—(1) Subject to subclause (2) of this clause no licence holder shall take or have in his possession, any trout or salmon which does not exceed 30 cm in length.

(2) No licence holder shall take or have in his possession any trout or salmon which does not exceed 22 cm in length taken from—

(a) These waters specified in clause 11(2); or

(b) The Waihou River and its tributary the Waimakariri Stream.

(3) Every licence holder taking a trout or salmon which does not exceed the specified length shall immediately return it, whether it is alive or dead, with as little injury as possible, into the water from which it was taken.

  1. Revocation—The notice published in the supplement to Gazette No. 183 of Thursday, 11 October 1984, on pages 4275-4276 titled District Anglers (Auckland Acclimatisation District) Notice 1984, is here by revoked.

District Anglers (Ashburton Acclimatisation District) Notice 1985

PURSUANT to section 71 of the Fisheries Act 1983, the Ashburton Acclimatisation Society hereby gives the following District Anglers Notice.

NOTICE

  1. Title and commencement—This notice may be cited as the District Anglers (Ashburton Acclimatisation District) Notice 1985, and shall come into force on the 1st day of October 1985.

  2. Interpretation—(1) In this notice—“Total weight” in relation to any rod fishing shall include the weight of anything attached to the line.

(2) Words and expressions in this notice which are defined in the Fisheries Act 1983 or the Freshwater Fisheries Regulations 1983 shall have the meanings so defined.

  1. Open season—(1) Subject to subclause (2) of this clause and to clause 4 of this notice, there shall be an open season for fishing for acclimatised fish from the 1st day of October in any year to the 30th day of April in the following year (both days inclusive).

(2) There shall be an open season for fishing for acclimatised fish from:

(a) the 1st day of May to the 31st day of May in the same year (both days inclusive) in Lake Camp (also known as Howard);

(b) from the first Saturday following Queen’s Birthday weekend to the 31st day of August in the same year (both days inclusive) in the Rakaia, Ashburton, and Rangitata Rivers downstream from the bridge spanning each of those rivers on the main south road;

(c) from the 1st day of May to the 30th day of September in the same year (both days inclusive) in the Rangitata Diversion Race between the point known as the Klondyke Intake and the central structure at the intake pipe of the Highbank power station.

(3) No licence holder shall fish for or take any acclimatised fish except during an open season.

  1. Closed season—(1) There shall be a closed season for fishing for acclimatised fish

(a) from the 1st day of March to the 30th day of April in the same year (both days inclusive) in the Rakaia River and its tributaries above Lake Coleridge powerhouse, that point being more particularly shown by white posts on the river banks;

Provided that this paragraph shall not apply to any lakes draining into the Rakaia River above the point specified;

(b) from the 1st day of March to the 30th day of April in the same year (both days inclusive) in the Rangitata River and its tributaries above the point known as Red Rocks Bluff, that point being more particularly shown by white posts on the river banks;

(c) from the 1st day of March to the 30th day of April in the same year (both days inclusive) in the Rangitata River from the west end of the Rangitata Gorge downstream to the confluence with Boundary Creek, both points being more particularly shown by white posts on the river banks;

(d) from the 1st day of October to the Friday preceding the first Saturday in November in the same year (both days inclusive), in any high country lake or tarn or any tributary of any such lake or tarn;

(e) from the 1st day of April to the 30th day of April in the same year (both days inclusive), in Bowyers Stream or in Taylors Stream or in the south branch of the Ashburton River from its source downstream to its confluence with Taylors Stream;

(f) from the 1st day of October in any year to the 30th day of September in the following year (both days inclusive) in the tail race from the Highbank power station or in the stream or side channel in the flood bed of the Rakaia River by which the waters from the said tail race enter the first main branch of the Rakaia River, the stream or side channel being indicated at its upper and lower ends by iron posts painted white.

(2) There shall be a closed season for fishing for quinnat salmon from the 1st day of March to the 30th day of April in any year (both days inclusive) in Lake Heron and its tributaries.

  1. Authorised tackle—(1) No licence holder shall fish for or take any acclimatised fish except by using a rod and running line.

(2) Notwithstanding subclause (1) of this clause,

(a) when playing an acclimatised fish, a landing net or gaff may be used to secure or land any such fish;

(b) for keeping acclimatised fish alive a keep net of not more than 1.8 metres in length may be used in the water from which that fish was taken.
