The Cream Price Notice 1985 (No. 2) (No. 3553; Ag. 4/51/12/9)

PURSUANT to section 25 of the Milk Act 1967, the Minister of Agriculture hereby gives the following notice.

NOTICE

  1. Title and commencement—(1) This notice may be cited as the Cream Price Notice 1985 (No. 2) and shall be read together with and deemed part of the Cream Price Notice 1985* (hereinafter referred to as "the principal notice").

SCHEDULE

MAXIMUM PRICE AT WHICH CREAM MAY BE SOLD

QUANTITY supplied on any one day, whether loose, or in bottles, or other closed containers and irrespective of number of deliveries.

At the Rate of cents per litre

  1. When sold to a vendor—
    (a) For resale to a commercial user or consumer in a quantity of less than 2.4 litres 212.00
    (b) For resale to a commercial user or consumer in a quantity of 2.4 litres or more 208.20
    (c) For resale to an occupier of a shop dairy—in any quantity 195.70

  2. When sold to an occupier of a shop dairy for resale—in any quantity 212.50

  3. When sold to a commercial user or consumer by a vendor—
    (a) In a quantity of less than 2.4 litres 75.00 cents per 300 ml
    (b) In a quantity of 2.4 litres or more 191.66 cents per litre

  4. When sold to a commercial user or consumer by an occupier of a shop dairy—in any quantity 75.00 cents per 300 ml

Price Order No. 317—(Milk Treatment Allowances)

I, Timothy Martin Sheppard, being duly authorised by the Secretary of Trade and Industry in this behalf, do hereby make the following price order in accordance with the provisions of section 89 of the Commerce Act 1975, and section 25 (3) of the Milk Act 1967 (as amended by section 6 of the Milk Amendment Act 1980).

  1. (1) This order may be cited as Price Order No. 317.
    (2) Special Approval S 637* is hereby revoked.

  2. In this order, unless the context otherwise requires:
    "The Act" means the Milk Act 1967:
    "Milk" has the same meaning as in the Act but does not include cream or goats' milk:
    "Milk district" means a milk district constituted and declared as a milk district under the Act:
    "Standard rates" means the standard rates of margins and allowances payable in respect of the treatment of town milk specified in the Schedule hereto:
    "Treatment" has the same meaning as in the Act, but does not include refrigeration in a storage depot elsewhere than at the treatment station, or the service of homogenisation by a treatment station:
    "Treatment station" means any plant or premises for the treatment of milk operated pursuant to the Act.

  3. This price order applies to all milk sold for human consumption in any milk district after the coming into force of this price order.

  4. The standard rates specified in the Schedule hereto are hereby fixed with effect from and including the 1st day of April 1985.

SCHEDULE

STANDARD RATES OF MARGINS AND ALLOWANCES PAYABLE FOR SERVICES PERFORMED IN RESPECT OF TOWN MILK

Nature of Service
Margin or Allowance at the Rate of Cents per Litre

  1. Treatment by treatment station if the aggregate quantity treated is:
    (1) 37 500 litres or over per day 9.80
    (2) 15 000 litres or over but less than 37 500 litres per day 11.01
    (3) 7 500 litres or over but less than 15 000 litres per day 11.19
    (4) Less than 7 500 litres per day 14.65

  2. Homogenisation by treatment station, if the aggregate quantity homogenised is:
    (1) 4 500 litres or over per day 1.20
    (2) 2 250 litres or over but less than 4 500 litres per day 1.60
    (3) Less than 2 250 litres per day 2.05

  3. Diverting to town milk industry by treatment station of skim milk if the aggregate quantity diverted is:
    (1) 4 500 litres or over per day 0.72
    (2) 2 250 litres or over but less than 4 500 litres per day 0.81
    (3) Less than 2 250 litres per day 0.90

  4. Storing by refrigeration in vendor's depot 1.11

  5. Storing by refrigeration in community depot 1.68

  6. Treatment by treatment station if such milk is not stored by refrigeration in the treatment station pending delivery but is stored elsewhere, and if the aggregate quantity treated is:
    (1) 37 500 litres or over per day 9.69
    (2) 15 000 litres or over but less than 37 500 litres per day 10.90
    (3) 7 500 litres or over but less than 15 000 litres per day 11.08
    (4) Less than 7 500 litres per day 14.54
