Any person desiring to oppose the Scheme is hereby required to give notice of his or her intention to do so to the Registrar of the High Court at Wellington and to the Public Trustee at Wellington and to the Secretary of the Anglican Boys’ Homes Society (Diocese of Wellington) Trust Board, P.O. Box 145, Masterton and to the Attorney-General not less than 7 clear days before the above mentioned date.

In the matter of the Charitable Trusts Act 1957, and in the matter of a certain application for an order approving a Scheme under Part III of the Charitable Trusts Act 1957, filed in the High Court of New Zealand at Auckland, under Number M. 1805/83 by the Public Trustee of New Zealand as executor and trustee of the Will of Charles Bagley, late of Auckland, Gentleman, deceased:
To all whom it may concern please take notice that the Public Trustee of New Zealand as executor and trustee of the Will of Charles Bagley late of Auckland, Gentleman, deceased and in pursuance of section 36 of the Charitable Trusts Act 1957, hereby give notice that he has applied to the High Court of New Zealand at Auckland, by way of notice of motion for an order approving a Scheme filed with such application propounded under Part III of the Charitable Trusts Act 1957, and relating to the trusts of the Will of the said Charles Bagley, deceased (hereinafter called “the deceased”). The particulars of such Scheme are as follows:

That the property (being a vacant section situate at 131–133 Grafton Road, Auckland), certain cash assets, and a settled fund subject to the trusts declared by paragraph 10 of the Will of the deceased are held upon trust for a charitable purpose in the manner set forth in a Scheme approved by this Honorable Court at Auckland on the 14th day of December 1964, under the Charitable Trusts Act 1957.

That it is impracticable or inexpedient to carry out such charitable purpose in the manner aforesaid.

That the new Scheme proposed and filed with the notice of motion under number M. 1805/83 is proper and not contrary to law, public policy, or good morals.

That should the proposed Scheme be approved by an order of the said High Court the property referred to in such Scheme shall be administered and managed by the Public Trustee under the title of the Bagley Trust subject to and in conformity with the provisions of the Scheme.

That the Public Trustee shall as soon as conveniently possible after the approval of the Scheme purchase (whether in one or more lots as the Public Trustee shall think fit) such piece or pieces of land situate in the Auckland Regional District (as constituted for the time being under the Auckland Regional Authority Act 1963 or any enactment passed or amendment thereof or in substitution therefor) as in his opinion is or are suitable for the purposes of the erection of self-contained dwelling units for elderly persons. The purchase price may be paid as more particularly detailed in such Scheme.

That the Public Trustee shall after he has purchased a piece of land in accordance with the foregoing authority sell or exchange (for land situated in the said Auckland Regional District suitable for the erection of self-contained dwelling units for elderly persons) the said land 131–133 Grafton Road, Auckland. The amount of the price shall be not less than such reserve as the Public Trustee thinks fit after he shall have first obtained a report from a Registered Public Valuer and otherwise such sale shall be upon such terms and conditions as the Public Trustee thinks fit.

That the Public Trustee shall as soon as conveniently possible after the acquisition of any piece of land in accordance with the foregoing authority erect on such land such number (as the Management Committee of the Bagley Trust may determine) of self-contained dwelling units for occupation by elderly persons (whether in the style of villas, flats, or apartments or otherwise and whether detached or not or furnished or not and including such other improvements and amenities as may be determined by the Management Committee).

That the said Scheme contains general and machinery provisions concerning the size materials form of construction plans and specifications and contracts for the erection of the said units.

That the Management Committee shall consist of the Mayor for the time being of the City of Auckland, the Senior District Judge for the time being exercising jurisdiction within the City of Auckland, the District Public Trustee for the time being of Auckland and such other persons as may be appointed from time to time by the Management Committee being not more than 3 in number.

That the Scheme also contains provision and machinery concerning the administrative powers and proceedings of the Management Committee.

That the Scheme also outlines those powers that with the approval of the Management Committee the Public Trustee shall have including without limiting the generality of the powers set out the power to receive donations or endowments for the general purposes of the Bagley Trust or for any special object or objects which may be connected with the due working of the provisions of that Scheme.

That the Scheme in paragraphs 23 and 24 thereof provides for certain directions concerning the destination application and devolution of the income and capital of the residuary estate of the Will of the deceased.
And please take further notice that the hearing in the High Court of New Zealand at Auckland of the application for approval of the Scheme shall take place on the 29th day of February 1983; and that any person desiring to oppose the Scheme shall give written notice of his intention to do so to the Registrar of the High Court at Auckland, and to the Public Trustee (at either 11/17 Mayoral Drive, Auckland or 117–129 Lambton Quay, Wellington) and the Attorney-General, Wellington, not less than 7 clear days before that date.
