THE CHARITABLE TRUSTS ACT 1957
NOTICE OF APPLICATION FOR APPROVAL OF A SCHEME UNDER PART III OF THE CHARITABLE TRUSTS ACT 1957
NOTICE is hereby given that the Public Trustee as trustee of the will of James Dawson Bashford, late of Kaupokonui in New Zealand, farmer, deceased, and as solicitor for the Anglican Boys' Homes Society (Diocese of Wellington) Trust Board has filed in the office of the High Court at Wellington an application for approval of a Scheme varying the terms of the said will under which the farm lands and the residuary estate of the above-named deceased are to be held. Under the said will, the farm lands and the residuary estate of the deceased were to be held by the Public Trustee for the purpose of establishing and running on the farm lands a home, under the control of a trust board, for boys under the age of 21 years who were orphans, or who needed assistance for any other reason, where such boys could learn practical farming out of school hours, but subject to the right of personal residence given to a niece of the deceased in the dwellinghouse on the farm lands and to the payment to the niece of an annuity of $800 during her lifetime. The Will also provided that if a trust board to run the proposed home was not incorporated within 10 years after the deceased's death, the farm lands and the residuary estate were to be transferred for the purpose of such home to that trust board of the Anglican Diocese of Wellington or other Anglican trust board appearing to the Public Trustee to be the proper authority to administer the home. The deceased died on 9 June 1963. No trust board has ever been incorporated to run a home for boys on the farm lands, because the establishment and running of such a home on the farm lands has become impracticable. The funds held by the Public Trustee in the residuary estate are insufficient to establish and maintain such a home on the farm lands. Under the Scheme, the Public Trustee shall transfer the farm lands and the residuary estate to The Anglican Boys' Homes Society (Diocese of Wellington) Trust Board to be held by the board to permit the above mentioned niece to continue personally to reside in the dwellinghouse erected on the farm lands and to receive an annuity of $800 during her lifetime, and subject thereto, to apply the income arising from the farm lands and the residuary estate in perpetuity for the purpose of providing scholarships or bursaries to assist in the education maintenance or benefit of boys born or living in New Zealand who are attending or desire to attend an agricultural or veterinary college or school or university in New Zealand for the purpose of furthering their education in farming or veterinary science.
