Land Acquired for State Primary School Teacher Housing in Frog Flat, Maruia Valley, Waimea County

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for State primary school teacher housing and shall vest in the Crown on the 12th day of April 1984.

Declaring Sewage Pipeline and Sewage Treatment Easements Acquired for a State Primary School in Block XI, Ruakaka Survey District, Whangarei County

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, a sewage pipeline easement over the land described in the First Schedule hereto, and a sewage treatment easement over the land described in the Second Schedule hereto, subject to the rights, and imposing the conditions contained in the Third Schedule hereto, such easements to be held appurtenant to the land described in the Fourth Schedule hereto, are hereby acquired for a State primary school and shall vest in the Crown on the 12th day of April 1984.

FIRST SCHEDULE

Sewage Pipeline Easement—Servient Tenement

ALL that piece of land containing 1114 square metres, situated in Block XI, Ruakaka Survey District, and being part Lot 2, D.P. 6671; as shown marked “A” on S.O. Plan 57778, lodged in the office of the Chief Surveyor at Auckland.

SECOND SCHEDULE
NORTH AUCKLAND LAND DISTRICT

Sewage Treatment Easement—Servient Tenement

ALL that piece of land containing 1354 square metres, situated in Block XI, Ruakaka Survey District and being part Lot 2, D.P. 6671; as shown marked “B” on S.O. Plan 57778, lodged in the office of the Chief Surveyor at Auckland.

THIRD SCHEDULE
NORTH AUCKLAND LAND DISTRICT

Rights and Conditions to Which the Easements are Subject

  1. The full, free uninterrupted and unrestricted right, liberty and privilege from time to time and at all times:

(a) to drain, discharge or convey sewage and other waste material and fluid by means of a line of sewage pipes through and under those portions of the registered proprietor’s property shown marked “A” and “B” on S.O. Plan 57778, and

(b) to lay, place, inspect, service, maintain and renew a line of sewage pipes through and under those portions of the registered proprietor’s property described above, and

(c) to enter upon the aforesaid portions of the registered proprietor’s property by the Crown’s servants, agents, engineers and workmen with or without any necessary vehicles, implements, tools and materials of any kind for the purpose of laying, placing, inspecting, servicing, maintaining and renewing the said line of sewage pipes

and opening up the soil thereof as necessary to carry out such work.

  1. The full, free, uninterrupted and unrestricted right, liberty and privilege from time to time and at all times:

(a) to hold and treat sewage and other waste material and fluid within oxidation ponds situated on the land described in the Second Schedule hereto, and

(b) to construct, inspect, service and maintain oxidation ponds situated on that portion of the said land, and

(c) to enter upon the said land by the Crown’s servants, agents, engineers and workmen, with or without any necessary vehicles, implements, tools and materials of any kind for the purposes of constructing, inspecting, servicing and maintaining the said oxidation ponds.

  1. The registered proprietor shall have the right during the continuance of the easements to discharge effluent from his cowshed into the oxidation ponds situated on the land described in the Second Schedule.

  2. The Crown, its servants, agents, engineers and workmen will, in exercising the rights, liberties and privileges described in clause 1 above, cause as little disturbance, as reasonably possible to the surface of the aforesaid portions of the grantor’s property and shall at no cost to the grantor restore the said surface as nearly as possible to its former condition.

  3. The costs of inspecting, servicing, maintaining and renewing the sewage pipeline described in clause 1 above shall be borne by the Crown.

  4. The costs of inspecting, servicing and maintaining the oxidation ponds described in clause 2 above shall be shared by the registered proprietor and the Crown on the basis that the registered proprietor shall pay one third (⅓rd) of such costs and the Crown shall pay two thirds (⅔rds) of such costs.
