Land Acquired for Horticultural Research Purposes in Block VI,
Hamilton Survey District, Waipa County

PURSUANT to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares that, an agreement to that effect
having been entered into, the land described in the Schedule hereto
is hereby acquired for horticultural research purposes and shall vest
in the Crown on the 5th day of April 1984.

All those pieces of land situated in Block VI, Hamilton Survey
District, described as follows:

Declaring a Cable Easement to be Acquired for Defence Purposes
in Block VII Waitemata Survey District, Takapuna City

PURSUANT to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares that an agreement to that effect
having been entered into, a cable easement, in gross, over the land
described in the First Schedule hereto subject to the terms and
conditions contained in the Second Schedule hereto, is hereby
acquired for defence purposes and shall vest in the Crown on the
5th day of April 1984.

FIRST SCHEDULE

NORTH AUCKLAND LAND DISTRICT

Servient Tenement

ALL that piece of land containing 475 square metres, situated in
Takapuna City, being Part Lots 3, D.P. 49823, as shown marked
“A” on S.O. Plan 54547, lodged in the office of the Chief Surveyor
at Auckland.

SECOND SCHEDULE

Terms and Conditions to Which the Easement is Subject

  1. The Crown shall have the right of entry at all times to enter
    upon the land being Lot 3, D.P. 49823, all certificate of title
    No. 108/1016, and more particularly the easement area together
    with all requisite machinery and conveyances for the purposes of
    laying, inspecting, maintaining, repairing or rewiring the cable or
    cables and for erecting and maintaining such fixtures as may be
    necessary to indicate the location of the cable or cables provided
    that the Crown shall make good any damage caused to the land or
    adjoining land or to any trees, fences, buildings or other assets there-
    on resulting from the exercise of the Crown’s rights of ingress on
    to or egress from the easement area or resulting from the carrying
    out of any work on the easement area whether any such damage is
    caused by the Crown, its agents servants or sub-contractors.

  2. The registered proprietor will not erect or permit to be erected
    any building structure or plant or permit to be planted
    any trees on the easement area.

  3. The registered proprietor shall have the right to draw electric-
    ity and have access to such other services as from time to time be
    routed through along and under the said easement area provided
    however that the facilities and the total draw off by such facilities
    do not impair the operational effectiveness of the present Ministry
    of Defence warning device and provided the registered proprietor
    meets all costs in providing such additional facilities.

having been entered into, a cable easement in gross over the land
described in the First Schedule hereto, subject to the terms and
conditions contained in the Second Schedule hereto, is hereby
acquired for defence purposes and shall vest in the Crown on the
5th day of April 1984.

ALL that piece of land containing 12 square metres, situated in
Takapuna City, being part Allotment 546, Paremoremo Parish; as
shown marked “B” on S.O. Plan 54547, lodged in the office of the
Chief Surveyor at Auckland.

SECOND SCHEDULE

NORTH AUCKLAND LAND DISTRICT

Terms and Conditions to Which the Easement is Subject

  1. The Crown shall have the right of entry at all times to enter
    upon the easement area together with all requisite machinery and
    conveyances for the purposes of laying, inspecting, maintaining,
    repairing or renewing the cable or cables and the hazard beacon
    and for erecting and maintaining such fixtures as may be necessary
    to indicate the location of the cable or cables.

  2. The surface soil of the easement area may be worked to a depth
    of 600 millimetres but in the event of the registered proprietor
    desiring to work the soil at a greater depth than 600 millimetres he
    shall before commencing any such work seek the prior approval of
    the Crown acting through the District Commissioner of Works,
    Auckland. Such approval shall not be unreasonably withheld.

  3. The registered proprietor will not erect or permit to be erected
    any building structure or structures or plant or permit to be planted
    any trees on the said easement area.

Declaring Easements Acquired for Post Office Purposes
(Microwave Station) in Block XII, Waiwera Survey District,
Rodney County

PURSUANT to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares that, an agreement between
George Bell (as grantor) and the Crown (as grantee) dated the 25th
day of July 1980, and held in the office of the District Commissioner
of Works at Auckland, having been entered into, right of way,
drainage, water supply, electric power and telephone cable easements
over the land described in the First Schedule hereto, appurtenant
to the land described in the Second Schedule hereto, vesting in the
Crown the rights and imposing the conditions contained in the said
agreement are hereby acquired for post office purposes and shall
vest in the Crown on the 5th day of April 1984.
