Thence generally easterly along that indigenous forest edge through Part 1, Section 1 and Part 2, Section 2, Whirinaki Block to its intersection with the southern side of State Highway No. 38 in Block V, Ahikereru Survey District, along the southern side of the said State Highway No. 38, to and along the western boundary of Section 7, Block V, Ahikereru Survey District to the northernmost corner of part Section 1, Block V, Ahikereru Survey District being the point of commencement excepting Heruwi 4F2 Block in Block IV, Ahikereru Survey District and Block 1, Tuwatawata Survey District.

Secondly all that area of land situated in the South Auckland Land District, Whakatane District, containing 135 hectares, more or less, within Block XIII, Ahikereru Survey District, bounded by a line commencing at the easternmost corner of Section 7 of the said Block XIII and thence generally northerly along the northern boundary of the said Section 7 to and across a public road to and along the northern boundary of Section 6 of the said Block XIII, to the western boundary of the eastern severance of part Section 4 of the said Block XIII thence easterly, southerly and northerly along the western boundary of the said eastern severance of part Section 4 to and along the western boundary of the land shown on plan numbered L. and S. 22/697 deposited in the Head Office of the Department of Lands and Survey at Wellington, to and across a public road to the easternmost corner of Section 7 of the said Block XIII, being the point of commencement excepting the public road.

The Eiffelton Irrigation Order 1984

PURSUANT to the Public Works Act 1981, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council hereby makes the following order:

ORDER

1. This order may be cited as the Eiffelton Irrigation Order 1984.

2. The area of land described in the Schedule hereto is hereby constituted as an irrigation district, to be known as the Eiffelton Irrigation District (herein referred to as “the district”).

3. Irrigation Scheme Headworks and Off-farm Works—The Minister of Works and Development is hereby authorised to construct, maintain and control the irrigation scheme headworks and off-farm works which are proposed to consist of a total of 10 wells with the associated pumps and ancillary electrical equipment. These will be situated at strategic points within the district boundary adjacent to the Deals, Windermere and Home Paddock drains. Water will be pumped into the drains to supplement existing flows and will be utilised by the farmers operating their own on-farm pumping systems for sprinkler irrigation.

4. Annual Basic Charge—Every occupier shall pay, as a minimum, the annual basic charge on all irrigable land within the district. This basic charge shall be $7.30 per irrigable hectare. The irrigability of any land is assessed from the nature of the land, the capability of the water supply works to supply water and availability of the water supply. The basic charge is intended to recover the farmer’s share of the capital costs of the headworks and off-farm works.

5. Annual Water Availability Charge—The annual water availability charge replaces the annual basic charge if equal to or greater than the annual basic charge. The annual water availability charge shall be $20.37 per unit rate of supply. One unit rate of supply is 130 m³/week. This is the design requirement for irrigating 1 hectare of land. This charge is intended to recover the basic charge plus the cost of operation, maintenance and renewal of the scheme.

6. Reduction in Charges During Development Period—There will be no reduction of charges and the charges will be at the full rate from the notified commencement of availability of supply of water.

7. Period of Charges—The number of seasons of supply over which charges will be payable will be 15 years from the notified time of commencement of availability of supply of water.

8. Basis of Charges—The charges are based on the estimated costs of the proposed scheme in terms of December 1982 money values. The basic charge is based on recovering 30 percent of the currently estimated $483,000 capital cost of construction of the scheme headworks and off-farm works plus interest at a rate of 9 percent, this being the appropriate current Rural Banking and Finance Corporation of New Zealand interest rate as at the date of the notification of this scheme under section 202, Public Works Act 1981. A scheme irrigable area of 2462 hectares has been used.

The water availability charge includes in full the estimated cost of operation and maintenance of the scheme.

The charges are subject to adjustment at the time of notification of commencement of availability of supply of water and at yearly intervals thereafter so as to account for the actual incurred cost and future estimated operation and renewal costs.

9. General Objectives of Scheme—The general objectives of the scheme are to provide additional irrigation water for agricultural purposes for land deemed suitable for irrigation.

10. Capability of Scheme—The nominal scheme irrigable area is 2462 hectares generally. It is calculated that the scheme will provide sufficient additional water, by pumping to supplement existing water resources in the 3 drains and taking due regard of stock water an
