Amending a Notice Declaring Land to be Road and Road
Stopped in Blocks I and V, Otanewainuku Survey District,
Tauranga County

PURSUANT to section 55 of the Public Works Act 1981, the Minister
of Works and Development hereby amends the notice dated the
15th day of June 1983, published in Gazette, 23 June 1983, No. 88,
page 4001, as amended by notice dated the 10th day of November
1983 and published in Gazette, 17 November 1983, No. 192, page
4001, declaring land to be road and road stopped in Blocks I and
V, Otanewainuku Survey District, Tauranga County, pursuant to
Part VIII of the Public Works Act 1981, by omitting paragraphs
(b) (i) and (ii) thereto and substituting the following:

(i) The area marked ‘A’ on the plan, now known as Allotment
829, Parish of Te Papa, shall vest in the Thomas Edwin
Tomsett, of Omanawa, farmer and Moira Jean Van Den Broek,
of Omanawa, married woman, as tenants in common in equal
shares subject to memoranda of mortgage S.286885 and
H. 460513, South Auckland Land Registry.

(ii) The area marked ‘B’ on plan, now known as Allotment 830,
Parish of Te Papa, shall vest in Henry Gerard Van Den Broek,
of Papamoa, carpenter and Lily Catherine Tomsett, of
Papamoa, bank officer, subject to memoranda of mortgage
H. 467524.4 and H. 467524.5, South Auckland Land Registry.

Drainage Easement Acquired For a Secondary School in the
Borough of Waiuku

PURSUANT to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares that, an agreement to that effect
having been entered into, a drainage easement, vesting in the Crown
the rights contained in paragraphs 3 and 5 of the Seventh Schedule
to the Land Transfer Act 1952 and subject to the conditions
contained in the First Schedule hereto is hereby acquired over the
land described in the Second Schedule hereto for a secondary school
and shall vest in the Crown on the 23rd day of February 1984.

FIRST SCHEDULE

NORTH AUCKLAND LAND DISTRICT

HER MAJESTY THE QUEEN shall be responsible for the regular
maintenance and repair of the open drain from the Constable Road
boundary to the watercourse shown on S.O. Plan 47728 and shall
restore and repair as near as is practicable any damage arising from
the operation thereof.
