  2. The Regional Superintendent of Education, Auckland, or his deputy, shall be an associate member of the Council of the Auckland Technical Institute and shall be entitled to be present at any meeting of the Council, or of any committee of the Council and to speak at the meeting, but he shall not be entitled to vote at any such meeting.

  3. (1) Subject to the provisions of this clause and the provisions of clause 3(m) of this notice, the members of the Council of the Auckland Technical Institute shall hold office for a term of 3 years but may, from time to time, be reappointed.

(2) Notwithstanding anything to the contrary contained in sub-clause (1) of the clause, the term of office of the following members shall be determined as follows:

(a) The 5 members appointed pursuant to clause 3(a), (b) and (k) of the Auckland Technical Institute Notice 1980* shall hold office until the 30th day of November 1984 on which date the 5 members to be appointed pursuant to clause 3(a), (b) and (j) of this notice shall commence office and shall thereafter be subject to the provisions of clause 5(1) of this notice;

(b) The four members appointed pursuant to clause 3(c), (d), (e) and (h) of the Auckland Technical Institute Notice 1980* shall hold office until the 30th day of November 1985 on which date the 4 members to be appointed pursuant to clause 3(c), (d), (e) and (g) of this notice shall commence office and shall thereafter be subject to the provisions of clause 5(1) of this notice;

(c) The 2 members appointed pursuant to clause 3(g) and (i) of the Auckland Technical Institute Notice 1980* shall hold office until the 30th day of November 1984 on which date the 2 members appointed pursuant to clause 3(f) and (h) of this notice shall commence office for a term of office to expire on the 30th day of November 1986 and shall thereafter be subject to the provisions of clause 5(1) of this notice;

(d) The one member appointed pursuant to clause 3(l) of the Auckland Technical Institute Notice 1980* shall hold office until the 30th day of November 1986 on which date the 1 member appointed pursuant to clause 3(k) of this notice shall commence office and thereafter be subject to the provisions of clause 5(1) of this notice;

(e) The one member appointed pursuant to clause 3(j) of this notice shall hold office until the 30th day of November 1986 on which date the 1 member appointed shall commence office and thereafter be subject to the provisions of clause 5(1) of this notice;

(f) The member appointed pursuant to clause 3(i) of this notice shall hold office contemporaneously with holding the office of Principal of Auckland Technical Institute, and shall not be subject to any term under this notice.

Thereafter, except in the case of a casual vacancy or as otherwise provided in this notice, every member shall hold office until the 1st day of December in the third year after that member’s election or appointment, and if on the 1st day of December the appointment or election of the successor has not been notified to the Council, that member shall continue to hold office until the date on which that appointment or election is so notified.

(4) If any member:

(a) Dies; or

(b) Resigns office by giving written notice addressed to the Council or to the Chairman or the Secretary thereof; or

(c) Is absent without leave from the meetings of the Council for 3 consecutive months; or

(d) While holding office becomes ineligible to remain a member by reason of disability, insolvency, neglect of duty or misconduct;

the casual vacancy so created shall be filled as soon as practicable thereafter by the appointment or election of a member in the manner in which the vacating member was appointed or elected. The member appointed or elected to fill the vacancy shall hold office for the residue of the term of office of the member whom that person replaces.

  1. The powers of the Council shall not be affected by any vacancy in the membership thereof.

  2. The Auckland Technical Institute Notice 1980* and Amendments† are hereby revoked. Subject to the provisions of this present notice the existing members shall remain in office as if this present notice were in force when each of these members took office.

The Heavy Engineering Research Levy Notice 1984

PURSUANT to section 5 of the Heavy Engineering Research Levy Act 1978, the Minister of Science and Technology hereby gives the following notice.

NOTICE

  1. Title and commencement—(1) This notice may be cited as the Heavy Engineering Research Levy Notice 1984.
    (2) This notice shall come into force on the 1st day of December 1984.

  2. Rates of research levy—There is hereby prescribed a research levy (within the meaning of the Heavy Engineering Research Levy Act 1978) of $5 a tonne on all levied items (within the meaning of that Act) payable—

(a) On any levied items which are entered for home consumption under the Customs Act 1966 on or after the 1st day of December 1984; and
