No. 183

(2) No person in fishing for acclimatised fish shall—
(a) Use as a lure or bait any fish taken from any water other than that in which it is being used as a lure or bait;
(b) User any lure or bait other than artificial fly in the following waters—
(i) The Hingaia Stream and its tributaries:
(ii) The Wairoa River and its tributaries above the Hunua Falls:
(iii) The Tairua River and its tributaries:
(iv) The Kauaeranga River and its tributaries:
(v) The Komata Stream and its tributaries:
(vi) The Maratoto Stream and its tributaries from its source to the ford on the old Whangamata track:
(vii) The Kakahu Stream (north-east of Okoroire) and its tributaries:
(viii) The Waipapa River and its tributaries upstream from the first waterfall situated approximately 0.5 km from Lake Waipapa:
(ix) The Mangatutu Stream and its tributaries from its source to the Lethbridge Road Bridge:
(x) The Puniu River and its tributaries from its source on Pirongia Mountain to its confluence with the Waipa River:
(xi) The Kaniwhaniwha Stream and its tributaries from its source on Pirongia Mountain to its confluence with the Waipa River:
(xii) The Awakino River and its tributaries from its source to the Mahoenui Bridge:
(xiii) The Ngakoaohia Stream and its tributaries from its confluence with and inclusive of the Mangamiti Stream downstream to its point of entry into Lake Karapiro:
(xiv) The Pokaiwhenua River and its tributaries from its confluence with the Mangamiti Stream downstream to its point of entry into Lake Karapiro:
(xv) The Little Waipa River from its source to its point of entry into Lake Karapiro;
(c) Cast with any fly line within 50 m of the shore of Hamilton Lake, except within the boundaries of that portion of the shore allocated as a casting range;
(d) Fish from any boat or launch in that part of the Waikato River between the upper limits of Lake Karapiro and the tail race of Lake Arapuni, unless such boat or launch is securely anchored.

  1. Daily limit bag—(1) No person shall on any 1 day take, kill, or have in possession more than 15 trout or salmon of which:
    (a) Not more than 5 may be taken from one or more of the following waters—
    (i) Pupuke:
    (ii) Lake Moananui:
    (iii) Lake Tomarata:
    (iv) Lake Ototoa:
    (v) Lake Whatihua (Thomsons Lake):
    (vi) Lake Otamataroa (Muirs Lake):
    (vii) The Hikutaia Cut:
    (viii) Smales Quarry Lake;
    (b) Not more than 8 may be taken, killed, or held in possession in the Wanganui River.
    (2) It shall be permissible to make up the difference between a lesser limit bag prescribed in 1 place and a higher limit bag prescribed in another place.
    (3) No person shall continue to fish for trout or salmon on any day on which he has already taken or killed 15 trout or salmon.

  2. Minimum size to be taken—(1) No person shall fish for, take, or kill in any manner whatever, or intentionally have in his possession, any trout or salmon which does not exceed:
    (a) 30 cm in length in the case of any trout or salmon from the Wanganui River;
    (b) 22 cm in length in the case of any trout or salmon from any other waters.
    (2) Every person taking a trout or salmon which does not exceed the specified length shall immediately return it, whether it is alive or dead with as little injury as possible, into the water from which it was taken.

  3. Revocation—The notice published in the supplement to the New Zealand Gazette, No. 222 of Thursday, 15 December 1983, on pages 4584–4585 titled District Anglers (Auckland Acclimatisation District) Notice 1983, is hereby revoked.

EXPLANATORY NOTE

This note is not part of the notice but is intended to indicate its general effect.

This notice continues the conditions under which a current licence holder may fish for acclimatised fish in the Auckland acclimatisation district, set out in the 1983 notice but—
(1) Alters the open season in some waters;
(2) Alters tackle restrictions in some waters;
(3) Removes the prohibition on disturbance of spawning redds or possession of eggs of acclimatised fish;
(4) Changes authorised lures and baits;
(5) Changes authorised fishing gear;
(6) Changes the daily limit bag and the minimum size of trout or salmon caught in the Wanganui River.

District Anglers (Bay of Islands, Hobson, Mangonui-Whangaroa and Whangarei Acclimatisation Districts) Notice 1984

PURSUANT to section 71 of the Fisheries Act 1983, the Bay of Islands, Hobson, Mangonui-Whangaroa and Whangarei Acclimatisation Societies hereby give the following District Anglers Notice.

NOTICE

  1. Title and commencement—This notice may be cited as the District Anglers (Bay of Islands, Hobson, Mangonui-Whangaroa and Whangarei Acclimatisation Districts) Notice 1984, and shall come into force on the day after the date of its notification in the New Zealand Gazette.

  2. Interpretation—Words and expressions in this notice which are defined in the Fisheries Act 1983 or the Freshwater Fisheries Regulations 1983 shall have the meanings so defined.

  3. Open season—Fishing for acclimatised fish by licence holders shall be permitted during the period from the 1st day of October in any year to the 30th day of September in the following year (both days inclusive).

  4. Authorised tackle—(1) Every person shall fish for, take, or kill acclimatised fish using only a rod and running line provided that for:
    (a) Playing an acclimatised fish, a landing net or gaff may be used to secure or land any such fish;
    (b) Taking small indigenous fish for bait in angling, a bait net not over 1.8 metres in length may be used;
    (c) Keeping alive acclimatised fish lawfully taken with rod and line in the same water, a keep net not over 1.8 metres in length may be used.

(2) No person shall use in fishing for acclimatised fish or have under his control more than 1 assembled rod and running line at any one time.

(3) No person shall fish for acclimatised fish with a rod and line unless he is in actual attendance within 15 metres of the rod and has the rod under his own visual observation.

  1. Prohibition on unauthorised fishing tackle, etc.—No person shall, when fishing for acclimatised fish or when in possession of an assembled fishing rod and gear suitable for fishing for acclimatised fish, have in his possession or under his control or convey or cause to be conveyed to the vicinity of any place where he is fishing or proposes to fish, any paravane, any stroke-hauling or foulhooking gear, any spear, any narcotic or poisonous substance or liquid injurious to fish.

  2. Authorised use of nets—(1) No person shall use or cause to be used for any purpose a net of any description, except as provided for in clause 4 of this notice, except:
    (a) A whitebait net;
    (b) Any net used for taking fish for the purposes of management or scientific investigations pursuant to an authority granted pursuant to section 72 of the Act:
    Provided that it shall be a defence for any person charged with a breach of this notice if he proves that he was netting for indigenous fish in accordance with the provisions of any regulations or notices in that behalf for the time being in force.

  3. Prohibition on possession or control of spear gun—No person shall, when taking any acclimatised fish or when in possession of any acclimatised fish, have in his possession or under his control any spear gun or pointed missile (other than a bullet) which is propelled by means of any mechanical or explosive device.
    (2) Where any person is charged with an offence under subclause (1) of this clause, it shall be a defence to the charge if the defendant proves that the spear gun or pointed missile in his possession or under his control was not used in taking the acclimatised fish.
    (3) In this clause the term “explosive” has the same meaning as in the Explosives Act 1957.
