District Anglers (Auckland Acclimatisation District) Notice 1984
PURSUANT to section 71 of the Fisheries Act 1983, the Auckland Acclimatisation Society hereby gives the following District Anglers Notice.
NOTICE
-
Title and commencement—This notice may be cited as the District Anglers (Auckland Acclimatisation District) Notice 1984, and shall come into force on the day after the date of its notification in the New Zealand Gazette.

Interpretation—Words and expressions in this notice which are defined in the Fisheries Act 1983 or the Freshwater Fisheries Regulations 1983 shall have the meanings so defined.

Open season—Fishing for acclimatised fish by licence holders shall be permitted during the period from the 1st day of October in any year to the 30th day of April in the following year (both days inclusive), provided that—
(a) There shall be no close season in the following waters—
(i) All lakes within the Auckland Acclimatisation District except Parkinson’s Lake;
(ii) The Wairoa River;
(iii) The Kauaeranga River downstream from its confluence with the Hihī Stream;
(iv) The Maratoto Stream, from the ford on the old Whangamata track (also known as the Wires Track) near the junction with the Hamuti Stream, to its confluence with the Waihou River;
(v) The Ohinemuri River, from the concrete bridge (known as the Victoria Street Bridge on the boundary between Waikī Borough and Ohinemuri County) to its confluence with the Waihou River;
(vi) The Waitawheta Stream, from the upstream end of the public vehicle access on Franklin Road (as shown by a signpost) to its confluence with the Ohinemuri River;
(vii) The Waikato River;
(viii) The Waipa River downstream from Toa’s Bridge (some 16 km upstream from Otorohanga) to its confluence with the Waikato River;
(ix) The Puniu River downstream from its junction with the Owairaka to its confluence with the Waipa River;
(x) The Mangawhio River between the Waikato River and the falls;
(xi) The Marokopa River from its junction with the Mangatuahaua Stream to its mouth;
(xii) The Mangaotaki River, from Battley’s Bridge (as shown by a signpost on the Mangaotaki Road (Pio Pio), to its confluence with the Mokau River;
(xiii) The Awakino River from the bridge at Mahoenui township to its mouth;
(xiv) The Wanganui River, downstream from its confluence with the Whakapapa River;
(b) There shall be an open season in the months of May and June of each year in the Wanganui River upstream from its confluence with the Whakapapa River;
(c) No person shall fish for, take, or kill any fish at any time in Parkinson’s Lake.
- Authorised tackle—(1) Every person shall fish for, take, or kill acclimatised fish using only a rod and running line provided that for—
(a) Playing an acclimatised fish, a landing net or gaff may be used to secure or land any such fish, except that a gaff may not be used in the Wanganui River;
(b) Taking small indigenous fish for bait in angling, a bait net not over 1.8 metres in length may be used;
(c) Keeping alive non-salmonid acclimatised fish lawfully taken with rod and line in the same water, a keep net not more that 2 metres in depth and placed so as to have the entry above the waterline may be used in the following waters:
(i) Lake Kuwhatakai;
(ii) Lake Kereta;
(iii) Lake Okaihau;
(iv) Lake Pupuke;
(v) Smales Quarry Lake;
(vi) Lake Puketi;
(vii) Any other pond or lake contained within any freehold land title.
(2) No person shall use in fishing for acclimatised fish or have under his control more than 1 assembled rod and running line at any one time.
(3) No person shall fish for acclimatised fish with a rod and line unless he is in actual attendance within 15 metres of the rod and has the rod under his own visual observation, except in the Wanganui River where a person must remain in attendance of the rod and line at all times.

Prohibition on unauthorised fishing tackle, etc—No person shall, when fishing for acclimatised fish or when in possession of an assembled fishing rod and gear suitable for fishing for acclimatised fish, have in his possession or under his control or convey or cause to be conveyed to the vicinity of any place where he is fishing or proposes to fish, any paravane, any stroke-hauling or foulhooking gear, any spear, any narcotic or poisonous substance or liquid injurious to fish.

Authorised use of nets—No person shall use or cause to be used for any purpose a net of any description, except as provided for in clause 4 of this notice, except:
(a) A whitebait net;
(b) Any net used for taking fish for the purposes of management or scientific investigations pursuant to an authority granted pursuant to section 72 of the Act:
Provided that it shall be a defence fo any person charged with a breach of this notice if he proves that he was netting for indigenous fish in accordance with the provisions of any regulations or notices in the behalf for the time being in force.
- Prohibition on possession or control of spear gun—(1) No person shall, when taking any acclimatised fish or when in possession of any acclimatised fish, have in his possession or under his control any spear gun or any pointed missile (other than a bullet) which is propelled by means of any mechanical or explosive device.
(2) Where any person is charged with an offence under subclause (1) of this clause, it shall be a defence to the charge if the defendant proves that the spear gun or pointed missile in his possession or under his control was not used in the taking the acclimatised fish.
(3) In this clause the term “explosive” has the same meaning as the Explosives Act 1957.

Fishing prohibited between certain hours—In the Wanganui River no person shall take trout during the period between the hours of 12 midnight and 5 a.m.

Authorised lures and baits—No person shall fish for acclimatised fish with any bait or lure other than artificial or natural fly, insect, worm, crustacea, minnow, fish (excluding fish ova or any portion of a fish or any shellfish (mollusca)), except in the following waters:
(i) Lake Kuwhatakai;
(ii) Lake Kereta;
(iii) Lake Okaihau;
(iv) Lake Pupuke;
(v) Smales Quarry Lake;
(vi) Lake Puketi;
(vii) Any other pond or lake contained within any freehold land title where any bait (excluding fish ova or any portion of a fish or any shellfish (mollusca)) may be used.
- Authorised fishing gear—(1) No person when fishing for acclimatised fish shall use—
(a) More than 2 lures or baits;
(b) Any lead or weight attached below or so as to hang below any lure or bait;
(c) In any water in which only artificial fly is permitted, any lead or weight other than the necessary weight or line, cast and fly;
(d) Any artificial fly having a multiple hook, or a hook which has a greater distance than 14 mm between the point and the nearest part of the shank;
(e) Any bait or lure treated with any medicinal or chemical preparation other than—
(i) In the case of artificial fly, oil used solely to give buoyancy to such flies; and
(ii) In the case of natural baits, a formalin or other preservative preparation;
(f) Any wire, either plain or twisted, or any gimp trace or cast of a greater thickness than 0.82 mm;
(g) Any wire or gimp trace or cast of a greater length than 1.8 metres;
(h) On or in conjunction with any spoonbait, minnow, or other lure any double or treble hook any 1 hook of which has a greater distance than 13 mm between the point and the nearest part of the shank of the hook, or any treble hook in the Wanganui River; or
(i) In conjunction with any spoonbait or artificial minnow, any lead or weight affixed to the trace or line at a distance of less than 38 cm above the lure.
