Declaring Land in South Auckland Land District, Vested in the Hamilton Education Board as a Site for a Public School, to be Vested in Her Majesty the Queen

A PROCLAMATION
PURSUANT to subsection (6) of section 5 of the Education Lands Act 1949, I, The Honourable Sir David Stuart Beattie, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto, being an area vested in the Hamilton Education Board as a site for a public school, shall be vested in Her Majesty the Queen, freed and discharged from every educational trust affecting the same, but subject to all leases, encumbrances, liens, or easements affecting the same at the date hereof.

SOUTH AUCKLAND LAND DISTRICT—MATAMATA COUNTY
4046 square metres, more or less, being Section 74, Block XVI, Cambridge Survey District. All New Zealand Gazette, 1911, page 2559. S.O. Plan 52673.

PURSUANT to section 138 of the Public Works Act 1981, His Excellency the Governor-General acting by and with the advice and consent of the Executive Council hereby revokes the Order in Council, dated the 27th day of August 1958 and published in the New Zealand Gazette, 28 August 1958, No. 53 at page 1135 and deposited in the Land Registry Office at Dunedin as No. 241024, declaring land to be a motorway in so far as it affects the land described in the Schedule hereto.

ALL that piece of motorway containing 1.8995 hectares, adjoining or passing through Lot 1, D.P. 17467 being part Section 69, part Lot 4, D.P. 3151 being part Section 67, Block XI, North Harbour and Blueskin Survey District and Lot 1, D.P. 7980 being part Section 5, Block X, North Harbour and Blueskin Survey District; as shown marked “A” on S.O. Plan 20799, lodged in the office of the Chief Surveyor at Dunedin.

The Northland Harbour Board Foreshore Control Order 1984

PURSUANT to section 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
-
Title and commencement—(1) This order may be cited as the Northland Harbour Board Foreshore Control Order 1984.
(2) This order shall come into force on the 30th day of November 1984. -
Interpretation—In this order—
“The Act” means the Harbours Act 1950:
“The Board” means the Northland Harbour Board constituted under the Harbours Act 1950:
“Foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides. -
Grant of Control—There is hereby granted to the Board for a period of 21 years from the 30th day of November 1984 and ending with the 29th day of November 2005 control of the foreshore described in the Schedule to this order.

Conditions of Grant—The grant of control conferred by clause 3 of this order is subject to the following conditions—
(a) Suitably worded signs shall be erected at main public access-ways to the foreshore described in the Schedule to this order indicating that control of the foreshore has been granted to the Board pursuant to section 165 of the Act.
(b) All money received by the Board in the performance or exercise of the functions, duties, or powers conferred on it by this order in respect of the foreshore to which this order applies, shall, after the deduction of any expenditure incurred by the Board in the performance or exercise of those functions, duties, or powers, be applied to the construction, repair or improvement of facilities in respect of that foreshore and not otherwise.
SCHEDULE
DESCRIPTION OF AREA
ALL that area of the foreshore within the Whangarei Harbour commencing at the southern end of the western boundary of Section 8, Block XIII, Whangarei Survey District, and proceeding southerly, north-easterly, and north-westerly generally to the south-eastern boundary of Section 2, Block XIV, Whangarei Survey District.
Also all that area of the foreshore within Whangarei Harbour including Parua, Munro, and McLeod Bays, commencing at the southern boundary of Section 1, Block XIV, Whangarei Survey District and proceeding south-easterly generally to the production westerly of the northern boundary of Lot 1, Deeds Plan 863, in Block IV, Ruakaka Survey District.
As the same are more particularly delineated on the plan marked M.D. 11607 and deposited in the office of the Secretary for Transport at Wellington, and thereon shaded blue.

PURSUANT to regulation 4 of the Raspberry Marketing Regulations 1979, I hereby appoint
Douglas Kemphorne McPhail, raspberry grower of Otaki, and Roger Bruce Membrey, berryfruit grower of Te Awamutu (on the nomination of the North Island Raspberry Marketing Committee)
to be members of the Raspberry Marketing Council for a term of 1 year from 1 August 1984.
