The Manukau City Council Foreshore, Seabed, and Waters Control Order 1984

ORDER IN COUNCIL

At the Government House at Wellington this 24th day of September 1984

Present:
His Excellency the Governor-General in Council

Pursuant to sections 8A and 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. Title and commencement—(1) This order may be cited as the Manukau City Council Foreshore, Seabed, and Waters Control Order 1984.

(2) This order shall come into force on the 1st day of October 1984.

  1. Interpretation—In this Order:

"The Act" means the Harbours Act 1950;

"The Council" means the Manukau City Council constituted under the Local Government Act 1974;

"Foreshore" means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides.

  1. Grant of Control—There is hereby granted to the Council for a period of 21 years from the 1st day of October 1984 and ending with the 31st day of September 2005 control of the foreshore, seabed, and waters described in the Schedule to this order.

  2. Conditions of Grant—The grant of control conferred by clause 3 of this order is subject to the following conditions:

(a) Suitably worded signs shall be erected at main public access ways to the foreshore, seabed, and waters described in the Schedule to this order indicating that control of them has been granted to the Council pursuant to sections 8A and 165 of the Act; and

(b) All money received by the Council in the performance or exercise of the functions, duties, or powers conferred on it by this order in respect of the foreshore, seabed, and waters to which this order applies shall, after the deduction of any expenditure incurred by the Council in the performance or exercise of those functions, duties, or powers, be applied to the construction, repair or improvement of facilities in respect of that foreshore, seabed, and waters, and not otherwise.

  1. Powers of Council—Subject to section 8A of the Act, the Council may, in respect of the foreshore, seabed, and waters to which this order applies—

(a) By bylaw, do anything which a Harbour Board may do by bylaw under section 232 of the Act;

(b) Appoint harbourmasters, and other officers, and define or limit their powers and duties.

  1. Revocations—The following orders are hereby revoked:

(a) Granting Control of the Waters fronting Beachlands—Te Puru and Omana-Maraetai to the Manukau County Council;

(b) The Manukau City Foreshore Control Order 1967;

(c) Amending Manukau City Foreshore Control Order 1967.

SCHEDULE

ALL that area of foreshore, seabed and waters 200 metres seaward of low waters ordinary spring tide mark adjacent to the City of Manukau excluding those areas within the Harbour Limits of Manukau and Waitemata Harbours, commencing at Musick Point and continuing generally south-easterly to the south-eastern boundary of the city and including the areas of seabed and waters enclosed by a line crossing Maungamaungaroa and Turanga Creeks commencing at the waters edge at the southern boundary of the borough of Howick to a point at the waters edge at the north-eastern head of Turanga Creek being the northernmost point of Lot 2, D.P. 54797, Block VIII, Otahuhu Survey District; and including the area of seabed and waters commencing at a point at the waters edge at the south-eastern head of section 6, Block IV, Wairoa Survey District, in a line crossing the head of Wairoa River to a point at the waters edge at the northernmost point of Pouto Point; and including all that area of seabed and waters in the Tamaki Strait bounded by a line commencing at a point at the waters edge at approximately latitude 36°53.2'S longitude 175°03.48'E; thence on a bearing 040° True for a distance of 140.8 m; thence on a bearing 310° True for a distance of 645 m; thence on a bearing 028°32' True for a distance of 268 m; thence on a bearing 298°30' True for a distance of 621 m; thence on a bearing 208°32' True for a distance of 268 m; thence on a bearing 298°30' True for a distance of 623.8 m; thence on a bearing 266° True for a distance of 5128 m to the waters edge at the north-east corner of Motukaraka Island; thence on a bearing 151°26' True for a distance of 568.7 metres to a point at the waters edge at approximately latitude 36°52.98'S longitude 174°59.0'E.

The above areas more particularly shown on plan M.D. 16206, deposited in the office of the Secretary for Transport in Wellington.

Appointing a Non-Elective Member of the Wairarapa Catchment Board and Revoking Previous Order in Council

DAVID BEATTIE, Governor-General

PURSUANT to section 44 of the Soil Conservation and Rivers Control Act 1941, I, The Honourable Sir David Stuart Beattie, the Governor-General of New Zealand, hereby:

(a) appoint:

Michael Anthony Albert Banks, District Ranger, Masterton

as a non-elective member of the Wairarapa Catchment Board for a period of 3 years commencing on the 4th day of October 1984;

(b) revoke the Order in Council dated 25 June 1979 published in the New Zealand Gazette on 19 July 1979, No. 64 at page 2160, appointing the person for the time being holding the office of Principal Ranger, New Zealand Forest Service, Palmerston North, as a non-elective member of the Wairarapa Catchment Board.

As witness the hand of His Excellency the Governor-General this 24th day of September 1984.
