Commerce Act 1975

NOTICE is hereby given of decision number 94 of the Commerce Commission dated 6 September 1984.

This decision relates to a collective pricing agreement operated by the South and West Otago and Southland Shearing Contractors’ Association registered by the Commission under the number 276, in respect of contract shearing rates. By this decision the Commission approved a pricing guide on the basis that it shall not contain any recommendation from the Association as to the price or any element of the price or the award rate which the contractor should use in completing the guide. The Commission’s approval is subject to the condition that the pricing guide must conform in substance to that attached to the decision. The Commission accepted in its decision

that the Association may from time to time attach to the pricing guide a separate document advising its members of current award rates.

The full text of this decision may be inspected at the Commission’s offices, Sixth Floor, 163 The Terrace, Wellington. Copies may be purchased on application to the Commission at P.O. Box 10273, Wellington.

The Standards Act 1965—Draft New Zealand Amendment Available for Comment

PURSUANT to subsection (3) of section 23 of the Standards Act 1965, notice is hereby given that the following draft amendment is being circulated.

Number and Title of Specification

DZ 3104/A1 Draft Amendment No. 1 to NZS 3104:1983 Concrete production—High grade and special grade. Gratis.

This draft amendment relaxes the frequency of some tests and corrects misprints.

All persons who may be affected by this publication and who desire to comment thereon may obtain copies from the Standards Association of New Zealand, Wellington Trade Centre, 15–23 Sturdee Street (or Private Bag), Wellington.

The closing date for receipt of comment is 13 December 1984.

Before the Broadcasting Tribunal

In the matter of the Broadcasting Act 1976 and in the matter of an application by the BROADCASTING CORPORATION OF NEW ZEALAND for short term broadcasting authorisations in Hawkes Bay:

REASONS FOR DECISION

THE BCNZ decided to establish an FM transmitter at Mount Erin at the same time as the installation was taking place of the Radio Hawkes Bay transmitter. The Corporation had lodged an application for amendment to 2YC AM warrant to permit the relay on stereo FM of Concert Programme transmission and for certain other amendments. The Tribunal considered it appropriate to permit that transmission to commence pending the decision of the Tribunal on the permanent YC related applications.

The Tribunal considered it appropriate to permit this application partly because it would assist in establishing the extent to which those who had been receiving the AM programme from the medium frequency station 2ZK would be satisfied with a stereo FM service only. It would also bring a new service to the area which had long been sought and in respect of which there was no known opportunities.

The reserved decision on the YC application was not completed as soon as expected and so extensions of time were given to enable the position to continue until that decision has been given. The decision was given in July and the station for the FM broadcasts was approved and the warrant could be amended. The only matter outstanding was the extension of hours which were approved in principle but further information had to be supplied by the BCNZ. It appears appropriate therefore that the station continue on a short term basis until the extension of hours can be approved by the Tribunal and incorporated in a warrant.

2ZK had rebroadcast the Concert Programme in the evenings and on Sundays and this service was not needed with the establishment of the FM Stereo Service from Mount Erin. The Corporation intimated that it had plans to apply for that station to extend its commercial hours which at present cease at 5 p.m. on weekdays.
