Decision No. 14/84
Reference No. Ind. 7/84
Before the Indecent Publications Tribunal
In the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the following publications: Them, Us, Two, Him, Me, I, Woman, You, published by Bantam Books, New York.
Chairman: Judge W. M. Willis.
Members: H. B. Dick, L. P. Nikera, J. V. B. McLinden, I. W. Malcolm.
Hearing: 23 May, 1984
Decision: 14 June 1984.
Appearances: C. F. Hillman for Comptroller of Customs. No appearance of importer Corgi and Bantam Books, Auckland.
DECISION
THE publications listed were commercially imported through the Port of Auckland, and are referred to the Tribunal for classification by the importer. It should be noted that 3 of the publications, Us, Woman and Two also appear under reference index No. 6/84, among the items referred to the Tribunal by the Tauranga District Court.
All of the publications are claimed to be written by “a well known authority whose books have sold several million copies and have been translated into virtually every language in the world”. The novels are written under the pseudonym, Anonymous, and to date the name of the author has not been revealed by the publishers, although most of these publications have been reprinted on numerous occasions since the first printing some 13 years ago.
One of the series written by Anonymous, Her, was classified as indecent in the hands of persons under the age of 18 years, in a majority decision, in 1971 (Decision No. 294). Even 13 years ago these publications caused some difficulty for the Tribunal, for in this decision the Tribunal noted that “Her is not a literary masterpiece, but it is skilfully written and is a good example of the erotic novel”.
