Appearances: Mr Leloir for Comptroller of Customs. No appearance of importer.
DECISION
THESE publications were referred to the Tribunal for classification following a prosecution against the importer in the District Court at Tauranga. Generally speaking, the publications are of a homosexual nature, although there are some, to which reference will be made, which do not have that characteristic. Mr Leloir who appeared for the Comptroller broke the various publications into seven categories. It is convenient to reproduce Mr Leloir’s submissions.
- The first group comprises hard core male homosexual pornography and it comprises the following publications:
Gay Boys, Nos. 4 and 5,
Javelin, No. 1,
Love Boys, 8,
Ramrod, Nos. 1, 3 and 4,
Homo Action, Nos. 14, 15 and 16,
Teen Angels,
Anal Sex, No. 7,
Gay, Nos. 58, 70 and 71.
It was Mr Leloir’s submission that they contain black and white or colour photos with little or no text. They fell into the category of hard core male homosexual pornography and were grossly injurious to the public good and therefore indecent. All these publications have been perused by the Tribunal which accepts the submissions made by Mr Leloir.
- The next group comprises simulated homosexual relations between males and it includes the following volumes:
Coltman, No. 3,
Weekend Lockup,
Rough Riders,
Sling, No. 1,
Pinning a Stud,
Three in the Bar,
The Falcon File, No. 6,
Olympus, Vol. No. 3,
Rocky Love Story,
Illustrated Sports, Nos. 4 and 5.
In respect of these publications, Mr Leloir said that they contain black and white or colour photos and limited text depicting simulated homosexual relations between males. He submitted they were grossly injurious to the public good and therefore indecent. Once again, these books have been perused by the Tribunal which agrees with the submissions of Mr Leloir.
- Sadomasochism and Bondage. In this group are the following publications:
Mister S. and M., No. 24,
Leather Bound, No. 3,
Bound to Serve, 4 and 6,
Leather Bondage Techniques, Vol. 2.
Once more there is a collection of black and white and colour photos with little or no text depicting homosexual males in bondage and homosexual males involved in acts of sadomasochism, sometimes with extreme violence. It was Mr Leloir’s submission that these were grossly injurious to the public good and therefore indecent. Once more, the Tribunal, having perused these publications, agrees with these submissions.
- Photos of Nude Males. These publications are:
Honcho, Vol. 1, No. 1,
Blue Boys, Vol. 19, 39, 42 and 43,
Blue Boy Introduces Paolo and Eduardo,
Mandate, Vol. 4, No. 40,
Bingo, No. 1,
Dune.
Again there is a series of publications with black and white and colour photos of entirely naked or near-naked males. There is little or no text and whilst they contain no explicit homosexual scenes there is a general emphasis on the display of genitalia. There is a
