Rate of Annual Orchard Levy Fixed (Notice No. 3015, Ag. 12/2/24)

PURSUANT to section 3 (1) of the Orchard Levy Act 1953, having regard to the recommendation of the New Zealand Fruitgrowers Federation Ltd., the annual rate of orchard levy payable is hereby fixed at $40. This levy is to be paid to the federation in the month of March every year by every person who, on the 31st day of January in that year, is the occupier of an orchard.

New Zealand Dairy Board—Notice of Election of Member for Eastern, Northern, and Wellington Wards

I, Peter Charles Horne, returning officer appointed under section 10 of the Dairy Board Act 1961, do hereby give notice of a poll to elect a member for the Eastern, Northern, and Wellington Wards on the New Zealand Dairy Board and do hereby give further notice that Wednesday, the 20th day of April 1983 is the date on which the rolls of electors for these wards shall be closed; that the nominations of candidates for the election must be in my hands by noon on Wednesday, the 18th day of May 1983; and that in the event of more than 1 candidate being nominated a poll will be held and that such poll will close at 7 p.m. on Wednesday, the 22nd day of June 1983.

Advertising the Taking of a Census—Section 31 (5) of the Statistics Act 1975

PURSUANT to section 31 (5) of the Statistics Act 1975, notice is given that a Census of Local Authorities (1982–83), which has been approved by the Minister of Statistics, is being undertaken by the Department of Statistics.

Before the Indecent Publications Tribunal

In the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the following publication: Men in Love, published by Arrow Books Limited, London:

DECISION

WE were told by the Comptroller of Customs that a single copy of this publication was imported by a commercial firm and seized at Auckland in September 1981. As the importer has disputed forfeiture the Customs Department has referred the publication to the Tribunal for classification prior to the commencement of condemnation proceedings under the Customs Act 1966.

Men in Love is a paperback approximately 527 pages in length. It was published by Arrow Books Ltd. in 1980 in Great Britain, and copyright is vested in the author Nancy Friday in 1980. Other publications written by the author include My Secret Garden, Forbidden Flowers, and My Mother, Myself. Only one of these books has been referred to the Tribunal—My Secret Garden in 1976. That publication was similar in style to Men in Love, except that it dealt with women’s sexual fantasies. In Decision No. 873 the Tribunal classified the book as not indecent saying:

“The Tribunal regards this (book) as an honestly conceived sociological study, …”

The attitude taken by the Department to the present publication was that it purported to be a serious study of men’s erotic fantasies.

The Department noted that the author did not appear to have any qualifications to make the publication an authoritative medical or scientific work. In those circumstances the Department suggested that an age restriction would be appropriate.

The classification of this book has caused us difficulty, for we have numerous misgivings about its quality. Some of the aspects of concern are:

  1. Unlike the Hite Report (Decision No. 913) or the Hite Report on Male Sexuality (Decision No. 1037) the present publication offers little in the way of background statistics on responses received etc. Ms Friday expressly disclaims the helpfulness of statistics in the topics covered in her publication (p. 13). She does however volunteer the information that she received some 3,000 responses, as a result of an advertisement inserted in her book Forbidden Flower. The responses were culled down to approximately 200 she felt to be the most representative. She did offer broad statistics as to age, education, marital status, and geographic distribution of her male correspondents, but other than those very general figures no further analysis was provided.

It also appears that the range of possible respondents was limited by the fact that the advertisement soliciting replies was inserted in the back of the novel referred to above. In our view the responses received from such a solicitation could hardly be said to fairly reflect the views of the male segment of American society.

The author admitted as much but said that the results culled by her were compared with responses received through a national men’s magazine and they were very similar. But in the finish we have serious reservations about the scientific or sociological value of this publication as opposed, for example, to the Hite Report.

  1. The book traverses numerous gross and perverted sexual practices. Some of these are:

(a) Water sports: The relevant activity in this chapter is urination (golden showers) or

(b) Defecation on one’s partner—cf pp. 187–189.

(c) Starry Eyed Oedipus: A succession of fantasies involving incestuous relationships with mothers and sisters. In one case pp. 163–165 the fantasy concerns an 11-year-old boy performing fellation on his father. The language is explicit and crude.

(d) Animals: This chapter covers sex with cows and a variety of canines.

The list could go on, but we believe that we have made the point that this publication deals with many bizarre, disgusting and unlawful sexual practices.

In considering our classification however we have had regard to what has been said by the Tribunal in Decision No. 877. That concerned an application by the Secretary for Justice for a classification of Forum magazine. There was a substantive hearing which took 2 days before the Tribunal. Witnesses from overseas and New Zealand were heard. The relevant passage from the decision reads as follows:

“… We have had most difficulty with The Forum which republishes letters said to have been sent from readers describing
