The notice must state the name, address, and description of the person, or if a firm, the name, address, and description of the firm, and an address for service within 3 miles of the office of the High Court at Napier, and must be signed by the person or firm, or his or their solicitor (if any), and must be served, or, if posted, must be sent by post in sufficient time to reach the above-named petitioner’s address for service not later than 4 o’clock in the afternoon of the 28th day of February 1984.

FRANKLIN COUNTY COUNCIL

NOTICE OF INTENTION TO TAKE LAND FOR ROAD

Notice is hereby given that the Franklin County Council proposes to take land for road under the provisions of the Public Works Act 1981. The land is located at Appleby Road, Drury and is more particularly described in the Schedule hereto.

The reasons why the Franklin County Council considers it essential to take the land are as follows:

(a) The land was laid off as road but never dedicated.

(b) Portion of the land has been formed as road to a very high standard.

(c) As road the adjoining land will be able to be subdivided and used for intensive farming purposes.

Notice is further given that plans showing the said land are deposited at the office of the council situated at Manukau Road, Pukekohe, and may there be inspected without fee by all persons during ordinary office hours.

Any person having any estate or interest in the land may within 20 working days after the date of this notice lodge an objection with the Planning Tribunal, Wellington. The right to object described above, relates to the taking of an interest in the land and not to the right to compensation.

If any objection is made in accordance with this notice a public hearing will be held unless the objector otherwise requires, and each objector will be advised the time and place of such hearing.

SCHEDULE

All that piece of land containing approximately 1.0900 hectares, being the land between the letters marked “A” and “B” on D.P. 119 and being part of the land contained in certificate of title 11/168.

The said piece of land is situated on Appleby Road.
