Declaring Land in the North Auckland Land District, Vested in the Auckland Education Board as a Site for a Public School, to be Vested in Her Majesty the Queen

A PROCLAMATION
PURSUANT to subsection (6) of section 5 of the Education Lands Act 1949, I, The Honourable Sir David Stuart Beattie, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto, being an area vested in the Auckland Education Board as a site for a public school, shall be vested in Her Majesty the Queen, freed and discharged from every educational trust affecting the same, but subject to all leases, encumbrances, liens or easements affecting the same at the date hereof.
SCHEDULE
NORTH AUCKLAND LAND DISTRICT—WHANGAREI COUNTY.
1.6187 hectares, more or less, being Section 22A, Block X, Hukerenui Survey District. All certificate of title, No. 1346/51. Together with water easements created by Transfer 592077, and Gazette notice A197170. S.O. Plan 13883.

The Clifton County Council Foreshore and Waters Control Order 1983

ORDER IN COUNCIL
At the Government House at Wellington this 31st day of October 1983
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to sections 8A and 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
-
Title and commencement—(1) This order may be cited as the Clifton County Council Foreshore and Waters Control Order 1983.
(2) This order shall come into force on the 1st day of December 1983. -
Interpretation—In this order—
"The Act" means the Harbours Act 1950:
"The Council" means the Clifton County Council constituted under the Local Government Act 1974:
"Foreshore" means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides. -
Grant of Control—There is hereby granted to the Council for a period of 21 years from the 1st day of December 1983 and ending with the 30th day of November 2004—
(a) Control of the foreshore described in the First Schedule to this order.
(b) Control of the waters described in the Second Schedule to this order. -
Conditions of Grant—The grant of control conferred by clause 3 of this order is subject to the following conditions—
(a) Suitably worded signs shall be erected at main public access ways to the foreshore and waters described in the Schedules to this order indicating that control of them has been granted to the Council pursuant to sections 8A and 165 of the Act.
(b) All money received by the Council in the performance or exercise of the functions, duties, or powers conferred on it by this order in respect of the foreshore and waters to which this order applies, shall, after the deduction of any expenditure incurred by the Council in the performance or exercise of those functions, duties, or powers, be applied to the construction, repair, or improvement of facilities in respect of that foreshore and waters and not otherwise.
- Powers of Council—Subject to section 8A of the Act, the Council may, in respect of the waters to which this order applies—
(a) By bylaw, do anything which a Harbour Board may do by bylaw under section 232 of the Act.
(b) Appoint harbourmasters, and other officers, and define or limit their powers and duties.
FIRST SCHEDULE
ALL that area of foreshore adjacent to the County of Clifton and all those areas of riverbed being:
(a) of the Onaero River from its confluence with the Mangapoua Stream to the sea;
(b) of the Urenui River from the downstream side of the State Highway No. 3 bridge to the sea;
(c) of the Tongaporutu River from its confluence with the Mangatoro Stream to the sea;
(d) of the Mimi River from its confluence with the Mangamaio Stream to the sea.
SECOND SCHEDULE
ALL that area of water 200 metres seaward of the waters edge adjacent to the County of Clifton and all the waters of the rivers being:
(a) of the Onaero River from its confluence with the Mangapoua Stream to the sea;
(b) of the Urenui River from the downstream side of the State Highway No. 3 bridge to the sea;
(c) of the Tongaporutu River from its confluence with the Mangatoro Stream to the sea;
(d) of the Mimi River from its confluence with the Mangamaio Stream to the sea.
The above areas described in the First and Second Schedules are more particularly shown marked green on plan MD. 16177, deposited in the office of the Secretary for Transport at Wellington.

PURSUANT to the Forest and Rural Fires Act 1977, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER

This order may be cited as the Matahina Rural Fire District Order 1949, Amendment No. 1, and shall be read together with and deemed part of the order constituting the Matahina Rural Fire District Order made on the 21st day of April 1949 (hereinafter referred to as the principal order).

This order shall come into force from the date of its notification in the New Zealand Gazette.

The principal order is hereby amended by revoking the Schedule thereto and substituting the Schedule hereto.
