DECISION

THIS publication was imported privately through Wellington Parcels Post on 4 March 1983 and later seized. Forfeiture has been disputed by the importer so that the Tribunal is asked to classify the publication prior to the commencement of condemnation proceedings.

The Tribunal has been told that the title translates approximately to Intimacy of the Mysterious Bedroom. The publication consists of text all in German, and as the Comptroller’s submission states, is liberally interspersed with photographs in both black and white and colour. The photographs are, in the main, all nude and semi-nude females often with male partners. A variety of sexual acts are depicted. The text is, we are told, a series of sexually oriented articles by a variety of authors on such topics as ‘I can make every woman weak’, ‘Cleopatra—her private parts got world fame’ and ‘How we react to Sex Films’. The Tribunal was invited to consider the publication as indecent.

For the vast majority of the public in New Zealand the only interest in this work would be in the photographs. Many of them are in posed or contrived positions and a number consist of more than two models. In such circumstances the publication can only be of interest to the lewd and prurient and thus injurious to the public good. It might be possible to make another classification if the text were in English. The Tribunal finds the publication as unconditionally indecent.

DECISION

THESE publications were imported commercially through parcels post and seized in August 1982. As forfeiture was disputed they were referred for classification.

Damsel and Young Ladies International are girlie type magazines consisting of coloured and black and white photographs of nude and semi-nude females in a variety of poses. In Damsel there is some text relating to the models and in Young Ladies International there are sex-related articles.

Australian Debonair magazines are pictorial—mainly nude and partly clad females, with a range of topics of a sexual but mainly non-sexual nature.

These magazines would compare with Mayfair, Decision 978, where an age restriction of 18 years was imposed. The Tribunal classifies these magazines as indecent in the hands of persons under the age of 18 years.

Rapture is a photographic publications of erotic fantasies. The photographs in black and white feature nude and semi-nude males and females in contrived poses. There is some text which is intended to explain each of the thirteen fantasies.

The Ultimate Kiss is a guide to oral sex. The photographs are of nude males and females and often display genitalia. The text contains detailed descriptions on the different aspects of oral sex. The photography in both magazines concentrates on the genitalia. The Tribunal classifies them as indecent.

Gallery Album Vol. I, No. 3, is a collection of 3 Gallery International magazines firmly bound inside the one cover. Each

is a self-contained magazine containing various articles both sexual and non-sexual. Each magazine contains black and white and coloured photographs, several ‘pictorials’ of nude or semi-nude models.

In each magazine there are 1 or 2 serious articles, but the remainder of the book is given over to sex related articles and photographs which concentrate on the genitalia. The Tribunal classifies this magazine as indecent.

Eveline, Eveline II, Beatrice, Pleasure Bound, and Sex Fire are all paperback novels. Eveline, Eveline II and Beatrice are anonymously written, described as classics and tell in detail the amorous adventures of Victorian ladies. Pleasure Bound contains 3 erotic novels written by an anonymous Edwardian author. Each novel tells of the sexual encounters of its hero or heroine. Sex Fire describes the sexual adventures of the main characters, and like the four previous novels, these accounts become the dominant feature of the book.

The Tribunal classifies each of these 5 novels as indecent.

Chapter 21: Restriction of access to private swimming pools. Gratis

This draft is a revision of NZS 9201:Model general bylaw—Part 21:1979 Restriction of access to private swimming pools. The purpose of this Chapter of this bylaw is to prevent the unsupervised access to swimming pools by children under 5 years of age and to thus reduce the risk of drowning.

All persons who may be affected by this publication and who desire to comment thereon, may obtain copies at the price shown, from the Standards Association of New Zealand, Wellington Trade Centre, 15–23 Sturdee Street (or Private Bag), Wellington.
