Private Schools Conditional Integration Act 1975

PURSUANT to section 10 of the Private Schools Conditional Integration Act 1975, notice is given that a supplementary integration agreement has been signed between the Minister of Education and the proprietor of the following school:

St Teresa’s School, Plimmerton.

The said supplementary integration agreement comes into effect on 29 August 1983. Copies of the supplementary integration agreement are available for inspection without charge by any member of the public at the Department of Education, Head office, Government Building, Lambton Quay, Wellington and at regional offices.

PURSUANT to the Pharmacy Act 1970, notice is hereby given that an election of members of the council of the Pharmaceutical Society of New Zealand will be held in the month of November 1983.

Before the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for decision in respect of the following publications: Sex Volume 3; Physique, publishers, Gay Sunshine Press, California, U.S.A.

DECISIONS

Sex Volume 3 is a series of short stories purported to be of true homosexual experiences. As submitted by Mr Hillman these stories are extremely graphic and they are interspersed with black and white full page photographs of nude males. It has no literary or artistic merit. It would have an appeal only for the lewd and prurient. The main objection to the publication is the fact that it is homosexually orientated. Homosexuality remains a crime in New Zealand and for that reason the publication must be classified as indecent.

Physique is presented as a pictorial history with the Athletic Model Guild. Most of the book consists of photographs of nude or near-nude males. No objection can be taken to the semi-nude photographs but the complete nudes show males in contrived or posed positions. It was submitted by Mr Hillman that the publication is similar to The Best of Sierra Domino which was ruled as indecent in Decision 974. Once again this publication would appeal to the lewd and prurient and on that account, it must be considered as injurious to the public. It is also classified as indecent.

DECISION

THIS publication is a single sample copy imported through Auckland Parcels Post on 3 March 1983. Forefeiture has been disputed by the importer so that it is referred to the Tribunal for classification prior to condemnation proceedings.

The publication is a soft cover book with text and photographs. Most of the photographs are mono-chromatic but there are 8 pages of coloured photographs. The preface of the book states: “This manual is both a fantasy guide and a practical collection of examples …” The text reflects this statement because it often diverges from technical description. A large number of pages are devoted to topics of group sex, oral sex, and anal intercourse.

It was submitted by the importer that this was a good quality sex manual from a publisher in this field. It contains over 200 photographs and illustrations. The author is said to have consulted a noted sex educator to obtain proof and it is claimed an excellent source for any man or woman who desires to refine and enhance their lovemaking techniques. It is claimed by the importer that it is similar to Perfecting Erotic Passions, Decision 1017 and Sexual Adventures in Marriage, Decision 988. Following those decisions an age restriction was suggested.

While in many respects this book is not very different from sex manuals which have come before the Tribunal on earlier occasions it certainly differs from the two publications already mentioned. The subject of group sex has already been made a subject of comment in Decisions Nos. 1053 and 1054. In any event anal sex
