  1. Boundaries of Mount Maunganui Borough and Tauranga County altered—The boundaries of the Borough of Mount Maunganui and the County of Tauranga shall be altered by excluding from the County of Tauranga and including in the Borough of Mount Maunganui the area of land described in the Schedule to this order (hereinafter referred to in this order as “the said area”).

  2. Transitional provisions—The Mount Maunganui Borough Council, in respect of the said area:

(a) Shall have and may exercise and be responsible for all the powers, duties, acts of authority, and functions which were previously exercised, or which would have been so exercised, by the Tauranga County Council;

(b) Shall have and may exercise and be responsible for all liabilities, obligations, engagements, and contracts which previously were, or which would have been, the responsibility of the Tauranga County Council;

(c) Shall have and may exercise and be responsible for all actions, suits, and proceedings pending by or against, or which would have been the responsibility of, the Tauranga County Council;

(d) Shall succeed to the bylaws which are in force and which are applicable to the authority’s altered circumstances and, until revoked or altered by the Mount Maunganui Borough Council, every such bylaw shall remain in force in the area in which it was in force immediately before the alteration of boundaries; and every bylaw which cannot be restricted to the area shall be deemed inapplicable and revoked in respect of the area by the alteration of boundaries;

(e) Shall succeed to all rates or levies and other money payable to the Tauranga County Council;

(f) Shall succeed to the valuation rolls, electoral rolls, and rate records in force in the area, and these shall remain in force until such rolls or records are made by the Mount Maunganui Borough Council; and until that time Part IX of the Rating Act 1967 shall apply as if the district in which the area was included was the district of a special purpose authority and the areas from which it was formed were constituent districts.

  1. Vesting of land—The corporation of the Mount Maunganui Borough shall, in respect of the said area, have vested in it, subject to all existing encumbrances, all land in that area vested in the corporation of Tauranga County.

  2. Mayor and principal administrative officer—The mayor and principal administrative officer of the Mount Maunganui Borough Council shall exercise the duties, powers, and functions of the chairman and principal administrative officer of the Tauranga County Council in respect of the said area.

  3. Creditors—Subject to section 37F of the Local Government Act 1974, the rights or interests of any district affected by this order shall not be affected.

  4. Rating—The system of rating in the said area shall continue to be the land value system.

SCHEDULE

BEING all that land in the South Auckland Land District, 35 hectares, more or less, bounded by a line commencing at a point, being the south-eastern corner of Section 17, S.O. 45378, situated in Block VI, Tauranga Survey District, and proceeding generally westerly then northerly along the southern and western boundaries of the aforesaid section then continuing northerly along the western boundary of Sections 18, 17 aforesaid and 16, Block VI, Tauranga Survey District, Sections 138, 132, part 105, 139, 120, part 105 aforesaid, 104 and part 105 aforesaid, Block VII, Tauranga Survey District; thence generally southerly along the eastern boundary of part Section 105, Block VII, Tauranga Survey District, as shown on S.O. 44549, and the eastern boundaries of Sections 132, 138, Block VII, Tauranga Survey District, and Section 17, Block VI, Tauranga Survey District, to the point of commencement.

Appointment of Honorary Vice-Consul for Mexico at Wellington

Appointment of Honorary Deputy Harboursmaster

I, Paul Leslie Bluett, Acting Controller, Marine Administration, pursuant to section 7 of the Harbours Act 1950, and in exercise of powers delegated to me pursuant to sections 8 and 9 of the Ministry of Transport Act 1968, hereby appoint

Ronald David Abbott

to be an honorary deputy harboursmaster for all the waters of Moeraki Port.

I, Paul Leslie Bluett, Acting Controller, Marine Administration, pursuant to section 7 of the Harbours Act 1950, and in exercise of powers delegated to me pursuant to sections 8 and 9 of the Ministry of Transport Act 1968, hereby appoint

to be a supervising officer for the Ministry of Transport for lakes Waitaki, Aviemore and Benmore, for the purposes of the Harbours Act 1950.
