59. PRIVATE SIDING TRAFFIC: HAULAGE, HANDLING AND TALLYING CHARGES AND WAGON MINIMA

59.1 Acceptance of private siding traffic

Where the loading or unloading of traffic is performed by consignors or consignees at private stores or sidings, the Corporation shall not accept the goods for carriage unless such goods are consigned at "owner's risk" or on "declared terms" in accordance with the provisions of the Carriage of Goods Act 1979.

59.2 Minimum wagon loads

Except as provided in clause 59.5 or when wagons are fully loaded, the charges for wagons consigned to or from a private siding shall be computed at the appropriate rate for the commodity on the following minimum weights:

Four Wheeled Wagon Bogie Wagon
Goods, not otherwise specified—tonnes 3.5 7.0
Goods classified classes G or G less a prescribed decrease—charge shall not be less than the charge computed at class C rates for—tonnes 3.5 7.0
Timber—cubic metres 3.5 7.0
Wool—undumped bales 20 40
dumped bales 10 20

59.3 Shunting charges

In cases where provision is made for a shunting charge to be enforced in respect of traffic to or from a private siding and a wagon containing less than the prescribed minimum is hauled, the shunting or haulage charge shall, except as provided in clause 59.6 be enforced according to whichever is the greater.

59.4 Shunting charge in lieu of rental

In any case where the annual siding rental has been waived and a shunting charge imposed in lieu thereof, the shunting charge shall be enforced in addition to haulage charges where such are applicable.

59.5 Local haulage

59.5.1 Haulage charge: Where goods are hauled between private stores or sidings, railway sheds, or public sidings at the same station with no other railage involved the haulage charge shall be as follows:

59.5.2 Handling: Where goods referred to in clause 59.7 are handled by the Corporation the following handling charges shall apply, provided that where cranage charges are incurred the provisions of clause 61.1 shall apply:

59.5.3 Tallying: Where goods referred to in clause 59.7 are tallied at the request of the owners, but not handled by the Corporation, the following charges for tallying will apply except that the Corporation will not undertake to tally timber:

59.6 Conditions

59.6.1 Topping up: The Corporation reserves the right to fill up at its sheds or yards any wagon not loaded to its full carrying capacity consigned to or from a private siding.

59.6.2 Responsibility of private siding holder: Holders of private sidings are held responsible for the safe custody of Corporation property of any kind while in their sidings, and must return such property to the Corporation in the same condition as when placed in the private siding.
