Notice of Approval of Bylaws
I, Paul Leslie Bluett, acting Controller Marine Administration, pursuant to section 165 of the Harbours Act 1950, and in exercise of powers delegated to me pursuant to sections 8 and 9 of the Ministry of Transport Act 1968, hereby approve the Taieri Mouth Foreshore Bylaw 1981, made by the Bruce County Council on 16 September 1981 and confirmed on 16 December 1981.

PURSUANT to regulation 6 of the Tuberculosis Regulations 1951, the Director-General of Health hereby gives notice that the following persons, additional to those contained in Gazette dated 25 March 1982, No. 34, page 1015, have been approved as qualified to perform vaccinations against tuberculosis in accordance with the provisions of the aforesaid regulations.

Before the Broadcasting Tribunal
IN the matter of the Broadcasting Act 1976, and in the matter of the complaint by HAROLD EARL JENSEN.

DECISION
Mr Jensen has complained that there was no acknowledgment of his complaint lodged with the Chairman of the Corporation. He considered his complaint should have been acknowledged within 14 days as a formal complaint.
He wants a replay of an interview on the Newsmakers programme which impressed him. Under the Broadcasting Act formal complaints should be lodged with the Secretary (not the Chairman) of the Corporation. Under the Act a formal complaint can only be lodged in respect of a programme that has actually been broadcast.
In this case the complainant wants a programme that has been broadcast to be broadcast again.
There is no jurisdiction under the Broadcasting Act for such a complaint. The Corporation was not therefore obliged to consider the complaint as a formal one under the Act.
Consequently the complaint cannot be upheld by the Tribunal.
The complaint is not upheld.

DECISION
A sample copy of the above publication was imported by Waverley Publishing Co. Ltd. and for some reason was seized by the Customs Department at Auckland. As the importer has disputed forfeiture of the publication the Customs Department referred it to the Tribunal for classification prior to the commencement of condemnation proceedings pursuant to the Customs Act 1966.
This book is a guide to lovemaking which has a text and accompanying colour photographs. It measures 165 mm × 235 mm, is 160 pages long and is a publication of high technical quality.
Both the Department and the importer seem to be of the view that the content of the book is also of a high standard. As the Department submitted:
“This is an illustrated manual showing various sexual techniques. The photographs are in keeping with the text which is informative and restrained. It is submitted that it is written with an honesty of purpose.”
In the submissions made by Gillian Campbell on behalf of Waverley International Ltd. it is stated:
“This is an excellent, good quality sex manual by one of the authors of Sexual Adventures in Marriage which was recently classified by the Tribunal (Decision No. 988). The author is also a director of the EURASE Institute for Marriage Counselling . . .”
