SCHEDULE

Kinds or Classes of Goods or Services Declared to be Subject to Section 106 of the Commerce Act 1975

New motor vehicles (including chassis and cabs) of the following kinds:

  1. Cars:
  2. Trucks, except trucks which are "goods service vehicles" as defined in section 2 of the Transport Act 1962 and which have a manufacturer's gross laden weight of 4500 kg or more:
  3. Vans:
  4. Ranch and station wagons.

PART II

Goods or Services to Which This Part Applies

  1. This part shall not apply with respect to any goods or services in any case where, prior to the date of coming into force of this notice, the Secretary has approved or fixed by a price order or a special approval a maximum selling price applicable to such goods or services.

  2. Except as provided in subclause 1 hereof, this part applies with respect to all goods or services specified in the Schedule hereto being goods or services that have been declared under Part I of this notice.

Prohibition of Sale

  1. Subject to the provisions of clause 4 hereof, the sale by any person whomsoever of any goods or services to which this part applies is hereby prohibited.

Provision for Withdrawal of Prohibition

  1. The prohibition of the sale by any person of any goods or services in accordance with this notice shall be deemed to be withdrawn with respect to those goods or services:
    (a) If and when a price order issued pursuant to section 89 of the Commerce Act 1975 comes into force with respect to the goods or services; or:
    (b) If and when a maximum selling price with respect to the goods and services has been authorised by a special approval pursuant to section 90 of the Act.

New motor vehicles (including chassis and cabs) of the following kinds:

  1. Cars:
  2. Trucks, except trucks which are "goods service vehicles" as defined in section 2 of the Transport Act 1962 and which have a manufacturer's gross laden weight of 4500 kg or more:
  3. Vans:
  4. Ranch and station wagons.

EXPLANATORY NOTE

This note is not part of the notice but is intended to indicate its general effect.

Following the commencement of this notice it is an offence under the Commerce Act 1975 to sell any new motor vehicle described in the Schedule to Part II of the notice unless a maximum selling price for that vehicle has first been approved by the Secretary of Trade and Industry pursuant to the Commerce Act 1975.
