  1. It is hereby declared that the annual basic charge payable in respect of irrigable land within the district shall be $135 per hectare and that the annual water availability charge payable in respect of water supplied shall be $155/water unit where a water unit is a flow rate of 1 cubic metre of water/hour.

  2. The annual basic and water availability charges shall be reduced for the first 6 seasons of supply as set out in the Second Schedule hereto.

  3. Basis of Allocation. Supply of water is subject to Crown Water Right No. 1232 and 1232A issued by the National Water and Soil Conservation Authority. The right provides for the continuous taking of up to 700 litres per second from the Wairoa River. The scheme will generally be capable of providing sufficient water to meet the design application rates of 38 mm/week for spray systems and 28 mm/week for trickle systems at all times over the whole irrigation district. It is anticipated that in dry seasons some rationing of water may be necessary. Water will be supplied at a pressure of approximately 320 kPa downstream of the ‘farm gate’ flow controls which will limit the flow of water on to a property to that allocated under the water availability agreement. The agreement will be based on the requirements of an approved on-farm irrigation plan that will ensure a system capable of meeting the scheme design application rates. The agreement shall be in accordance with section 216 of the Public Works Act 1981. In seasons where rationing is required, the water availability charges may be reduced by the Minister of Works and Development for that season as allowed for in section 218 in the Act.

  4. It is hereby declared that after the seventh season of water availability, the annual basic and water availability charges shall be subject to annual adjustment to compensate for any difference in any element of these charges from the amount previously estimated as stated under section 210 and 212 of the Public Works Act 1981.

  5. It is hereby declared that ‘land’ in relation to any occupier or ratepayer in the irrigation district means all that land occupied by that person in the district which aggregates not less than 2 hectares.

FIRST SCHEDULE
WAIMEA EAST IRRIGATION DISTRICT

DESCRIPTION of land to be included in the proposed irrigation district: all that area in the Nelson Land District situated in the Waimea County bounded by a line commencing at the southernmost corner of Section 160, District of Waimea East, situated in Block VI, Waimea Survey District, and proceeding south-easterly along the north-eastern side of the Richmond to Collingwood State Highway to the westernmost corner of part Section 108, District of Waimea East, being a main highway depot as described in Gazette, 1948, page 1226; thence south-westerly along a right line crossing the said highway to the northernmost corner of Lot 20, D.P. 4875; again south-westerly along the north-western boundaries of Lots 20, 17, 5 and 4, D.P. 4875, and Lot 2, D.P. 8642, to the westernmost corner of the said Lot 2; thence generally south-easterly along the generally south-western boundaries of the said Lot 2 to the north-western side of No. 6 State Highway; thence north-easterly along that side to a point in line with the north-eastern boundary of Lot 1, D.P. 6754; thence south-easterly to and along that boundary and the north-eastern boundary of Lot 2, D.P. 6754 to its easternmost point; thence south-westerly and south-easterly along the north-western and south-western boundaries of part Section 20, District of Waimea East, comprised in certificate of title 2A/537 to the north-western side of Paton Road; thence north-easterly along that side to the north-eastern side of Hart Road; thence south-westerly along that side to the south-eastern side of Hill Street; thence south-westerly along that side and the south-eastern side of Haycock Road to the south-western side of Clover Road East; thence north-easterly along that side to a point in line with the south-eastern boundary of Lot 2, D.P. 7317; thence north-easterly to and along that boundary to its easternmost point; thence generally north-westerly along the north-eastern and north-western boundaries of the said Lot 2 and the last-mentioned boundary produced to the south-western side of Clover Road East; thence north-westerly along that side to a point in line with the western boundary of Lot 1, D.P. 8516; thence generally northerly to and along that boundary, the western and north-western boundaries of Lot 2, D.P. 8516, the north-western boundaries of Lots 3 and 4, D.P. 8516, and the south-western boundary of Lot 11, D.P. 4480, to the south-eastern side of No. 6 State Highway; thence south-westerly along that side to a point in line with the south-western boundary of Lot 1, D.P. 6825; thence north-westerly to and along that boundary, the south-western boundary of part Lot 1, D.P. 3196, comprised in certificate of title 3A/315 and the last-mentioned boundary produced to the south-eastern boundary of Lot 3, D.P. 8716; thence generally north-westerly along the south-eastern, north-eastern boundaries of the said Lot 3, the south-eastern, north-eastern and north-western boundaries of Section 224, District of Waimea East, situated in Block VI, Waimea Survey District, and the north-eastern boundary of Lot 3, D.P. 8713, to its northernmost point, thence generally northerly along the north-western and south-western boundaries of Lot 1, D.P. 8713, and the last-mentioned boundary produced across Pughs Road to its north-western side; thence north-easterly along that side and its production across the Richmond to Collingwood State Highway to the point of commencement.
